70 ILCS 1005/1  from Ch. 111 1/2, par. 74

    Amends the Mosquito Abatement District Act. Makes a technical change in a Section concerning a petition for a referendum on the question of organizing a mosquito abatement district.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Mosquito Abatement District Act is amended
5by changing Section 1 as follows:
 
6    (70 ILCS 1005/1)  (from Ch. 111 1/2, par. 74)
7    Sec. 1. Any contiguous territory having a population of not
8less than 300 inhabitants and and no part of which is already
9included in a mosquito abatement district may be organized as a
10mosquito abatement district in the following manner:
11    Any 5% of the legal voters within the limits of the
12proposed mosquito abatement district may petition the circuit
13court for the county in which such territory lies, to order the
14question whether such territory shall be organized as a
15mosquito abatement district under this Act to be submitted to
16the legal voters of such territory, but every petition shall be
17signed by at least 25 legal voters residing within the
18territory proposed to be organized as a mosquito abatement
19district, and in case such territory includes more than one
20city, village or incorporated town, or any portions thereof, or
21includes one or more cities, villages or incorporated towns, or
22any portion thereof and territory not a part of any city,
23village or incorporated town, then such petition must be signed

1by at least 5% of the legal voters residing in each of the said
2cities, villages, or incorporated towns, or portions thereof,
3and by at least 5% of the legal voters residing in the
4territory not a part of any city, village or incorporated town.
5Such petition addressed to the court shall contain a definite
6description of the boundaries of the territory proposed to be
7organized as a mosquito abatement district, and shall set forth
8the name of the proposed district, which name shall be The....
9Mosquito Abatement District.
