SYNOPSIS AS INTRODUCED:
 
30 ILCS 105/5.866 new
625 ILCS 5/3-699.14 new

    Amends the Illinois Vehicle Code and the State Finance Act. Provides for the issuance of Choose Life license plates. Provides that, in addition to the appropriate registration fees, an applicant for the special plate shall be charged a fee of $25 at original issuance and $25 at renewal. Provides that $15 of the original issuance fee and $2 of the renewal fee shall be deposited into the Secretary of State Special License Plate Fund. Provides that $10 of the additional original issuance fee and $23 of the renewal fee shall be deposited into the Choose Life Fund, a new special fund in the State treasury. Provides that all money in the Choose Life Fund shall be distributed in accordance with a specified formula to all applying qualified non-governmental, not-for-profit agencies whose services include counseling and meeting the material needs of pregnant women who are planning to place their children for adoption and contains other provisions regarding the distribution of money from the Choose Life Fund.

1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The State Finance Act is amended by adding
5Section 5.866 as follows:
 
6    (30 ILCS 105/5.866 new)
7    Sec. 5.866. The Choose Life Fund.
 
8    Section 10. The Illinois Vehicle Code is amended by adding
9Section 3-699.14 as follows:
 
10    (625 ILCS 5/3-699.14 new)
11    Sec. 3-699.14. Choose Life license plates.
12    (a) The Secretary, upon receipt of an application made in
13the form prescribed by the Secretary, may issue special
14registration plates designated as Choose Life license plates to
15any person who wishes to demonstrate support of organizations
16that encourage adoption as a positive choice for women with
17unplanned or unwanted pregnancies. The special plates issued
18under this Section shall be affixed only to passenger vehicles
19of the first division and motor vehicles of the second division
20weighing not more than 8,000 pounds. Plates issued under this
21Section shall expire according to the multi-year procedure

1established by Section 3-414.1 of this Code.
2    (b) The Secretary shall confer with Illinois Choose Life,
3Inc. regarding the design, color, and format of the plates,
4which shall carry the words "Choose Life".
5    The Secretary may also allow the plates to be issued as
6vanity plates or personalized plates under Section 3-405.1 of
7this Code. The Secretary shall prescribe stickers or decals as
8provided under Section 3-412 of this Code.
9    (c) An applicant for the special plates shall be charged a
10$25 fee for original issuance in addition to the appropriate
11registration fee. Of this $25 fee, $10 shall be deposited into
12the Choose Life Fund and $15 shall be deposited into the
13Secretary of State Special License Plate Fund, to be used by
14the Secretary to help defray the administrative processing
15costs.
16    For each registration renewal period, a $25 fee, in
17addition to the appropriate registration fee, shall be charged.
18Of this $25 fee, $23 shall be deposited into the Choose Life
19Fund and $2 shall be deposited into the Secretary of State
20Special License Plate Fund.
21    (d) The Choose Life Fund is created as a special fund in
22the State treasury. All moneys in the Choose Life Fund shall be
23paid, subject to appropriation by the General Assembly and
24distributed by the Secretary, on a pro-rated basis at the
25beginning of each fiscal year to all applying qualified
26non-governmental, not-for-profit agencies whose services

1include counseling and meeting the material needs of pregnant
2women who are planning to place their children for adoption. No
3moneys may be distributed to organizations described in
4subsection (f) of this Section. Moneys shall be distributed to
5the applying qualified agencies in each county in direct
6proportion to the number of "Choose Life" registrations and
7renewals attributable to that county. Any unused moneys in
8excess of 10% of the moneys allocated to a qualified non-profit
9organization shall be returned to the Choose Life Fund at the
10end of the fiscal year to be aggregated and distributed with
11the next fiscal year's distributions to that county's qualified
12agencies.
13    (e) To apply to be determined a qualified agency and
14receive the moneys available through the Choose Life Fund, an
15organization must deliver to the Secretary a notarized
16affidavit signed by a duly appointed representative of the
17organization under penalties of perjury that states the
18following is true and correct to the best of his or her
19knowledge:
20        (1) The organization is a non-profit organization.
21        (2) The organization does not discriminate because of
22    race, marital status, gender, religion, national origin,
23    handicap, or age.
24        (3) The organization is committed to counseling
25    pregnant women about the option of adoption.
26        (4) The organization is not involved or associated with

1    any abortion activities, including counseling for or
2    referrals to abortion clinics, providing medical
3    abortion-related procedures, or pro-abortion advertising.
4        (5) The organization does not charge women for any
5    services received.
6        (6) The organization understands and agrees that no
7    more than 60% of the moneys received may be used for the
8    material needs of pregnant women who are planning to place
9    their children for adoption, including, but not limited to,
10    clothing, housing, medical care, food, utilities, and
11    transportation. These moneys may also be expended on birth
12    mothers up to 60 days after delivery and on infants
13    awaiting placement with adoptive parents. Agencies that
14    receive these moneys shall use no more than 40% of the
15    moneys received to enhance their adoption efforts,
16    including, but not limited to counseling, training, and
17    advertising.
18        (7) These moneys may not be used for administrative
19    expenses, legal expenses, or capital expenditures.
20        (8) The organization understands and agrees that any
21    unused moneys at the end of the fiscal year that exceed 10%
22    of the moneys received by the organization during the
23    fiscal year must be returned to the Choose Life Fund to be
24    aggregated and distributed with the next fiscal year
25    distribution to that county's qualified applicants.
26        (9) The organization understands and agrees that each

1    organization that receives funds must submit a notarized
2    annual affidavit attesting the funds received were used in
3    the manner described in this Section.
4    (f) Moneys in the Choose Life Fund may not be distributed
5to any organization involved or associated with any abortion
6activities, including counseling for or referrals to abortion
7clinics, providing medical abortion-related procedures, or
8pro-abortion advertising. Funds may not be distributed to any
9organization that charges women for any services received.
10    (g) 60% of the moneys received from the Choose Life Fund
11may be used for the material needs of pregnant women who are
12planning to place their children for adoption, including, but
13not limited to, clothing, housing, medical care, food,
14utilities, and transportation. These moneys may also be
15expended on birth mothers up to 60 days after delivery and
