SYNOPSIS AS INTRODUCED:
 
405 ILCS 5/4-710 new

    Amends the Mental Health and Developmental Disabilities Code. Provides that the Department of Human Services shall obtain the services of the staff of State-operated developmental disability facilities to develop and implement transition plans for recipients who are being transferred from a State-operated developmental disability facility to another facility or to another care setting. Provides that the Department may not enter into a contract with any person who is not a staff member of a State-operated developmental disability facility to provide transition services to residents of State-operated developmental disability facilities. Effective immediately.

1    AN ACT concerning health.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Mental Health and Developmental
5Disabilities Code is amended by adding Section 4-710 as
6follows:
 
7    (405 ILCS 5/4-710 new)
8    Sec. 4-710. Closure of facilities; transition plans.
9    (a) The Department shall obtain the services of the staff
10of State-operated developmental disability facilities to
11develop and implement transition plans for recipients who are
12being transferred from a State-operated developmental
13disability facility to another facility or to another care
14setting.
15    (b) The Department may not enter into a contract with any
16person who is not a staff member of a State-operated
17developmental disability facility to provide transition
18services to residents of State-operated developmental
19disability facilities.
 
20    Section 99. Effective date. This Act takes effect upon
21becoming law.
