SYNOPSIS AS INTRODUCED:

405 ILCS 5/4-710 new

Amends the Mental Health and Developmental Disabilities Code. Provides that the Department of Human Services shall obtain the services of the staff of State-operated developmental disability facilities to develop and implement transition plans for recipients who are being transferred from a State-operated developmental disability facility to another facility or to another care setting. Provides that the Department may not enter into a contract with any person who is not a staff member of a State-operated developmental disability facility to provide transition services to residents of State-operated developmental disability facilities. Effective immediately.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Mental Health and Developmental Disabilities Code is amended by adding Section 4-710 as follows:

(405 ILCS 5/4-710 new)

Sec. 4-710. Closure of facilities; transition plans.

(a) The Department shall obtain the services of the staff of State-operated developmental disability facilities to develop and implement transition plans for recipients who are being transferred from a State-operated developmental disability facility to another facility or to another care setting.

(b) The Department may not enter into a contract with any person who is not a staff member of a State-operated developmental disability facility to provide transition services to residents of State-operated developmental disability facilities.

Section 99. Effective date. This Act takes effect upon becoming law.
