| 1 | | AN ACT concerning local government.
| 2 | | Be it enacted by the People of the State of Illinois,
| 3 | | represented in the General Assembly:
| 4 | | Section 5. The Park District Code is amended by changing | 5 | | Section 2-2.1 as follows:
| 6 | | (70 ILCS 1205/2-2.1) (from Ch. 105, par. 2-2.1)
| 7 | | Sec. 2-2.1.
(a) When 2 or more park districts are situated | 8 | | entirely within
the corporate limits of the same municipality, | 9 | | a park district coterminous with
such municipality may be | 10 | | organized in the manner hereinafter provided, and,
when so | 11 | | organized, shall supersede the park districts previously | 12 | | existing
within the limits of the municipality. The petition to | 13 | | organize such a park
district shall comply with the | 14 | | requirements of Section 2-2, but must be
signed by not less | 15 | | than 100 legal voters residing in each of the existing
park | 16 | | districts and, if the municipality includes territory not | 17 | | included
within any existing park district, by at least 100 | 18 | | legal voters residing in
such territory or by at least 10% of | 19 | | the legal voters residing in such
territory, whichever is less. | 20 | | The petition shall also state whether the
proposed district | 21 | | shall have 5 elected commissioners or 7 appointed
| 22 | | commissioners. If the proposed district shall have 7 appointed
| 23 | | commissioners, the chief executive officer of the |

| 1 | | municipality, with the
advice and consent of the corporate | 2 | | authorities, shall appoint the
commissioners. The initial | 3 | | appointed commissioners shall serve terms
determined by lot as | 4 | | follows: 2 for terms of 2 years, 2 for terms of 4
years, and 3 | 5 | | for terms of 6 years. Thereafter, appointed commissioners
shall | 6 | | serve for terms of 6 years. A vacancy in the office of | 7 | | appointed
commissioner shall be filled for the unexpired term | 8 | | in the same manner as
an original appointment. "Municipality" | 9 | | as used in this Section means a city, village or
incorporated | 10 | | town.
| 11 | | (b) (Blank). When 2 or more municipalities, one of which | 12 | | having a population of
less than 500, are situated within a | 13 | | park district, the park district may
be reorganized into 2 new | 14 | | park districts, one of which shall be coterminous
with the | 15 | | municipality having a population of less than 500, and one of | 16 | | which
shall be coterminous with the remaining territory of the | 17 | | park district.
A petition to reorganize such park district | 18 | | shall comply with the requirements
of Section 2-2, but must be | 19 | | signed by at least 100 legal voters residing in the
district to | 20 | | be reorganized. Title and possession of all real property and
| 21 | | permanently located personal property of the district to be | 22 | | reorganized
shall vest in the new district in which the | 23 | | property is located.
Each new district shall succeed to its | 24 | | proportionate share of the bonded
indebtedness of the | 25 | | reorganized district, to be determined according to
the value, | 26 | | as equalized and assessed by the Department of Revenue, of all

| 1 | | taxable property in each new district. Title and possession to | 2 | | all other
property of the district as well as all other rights | 3 | | and obligations of
the district shall be equitably distributed | 4 | | and apportioned between the 2
districts, as determined by the | 5 | | governing boards of both park districts.
In the event that no | 6 | | agreement can be reached, the court in which
the petition was | 7 | | filed to organize the new districts shall make the
| 8 | | determination. All monies of the district on hand and all | 9 | | monies received
from taxes levied before the creation of the 2 | 10 | | new districts shall be paid
on a pro rata basis to each new | 11 | | district according to the value, as
equalized and assessed by | 12 | | the Department of Revenue, of all taxable
property in each new | 13 | | district. This subsection (b) shall be effective only
until | 14 | | January 1, 1987.
| 15 | | (c) (Blank). "Municipality" as used in this Section means a | 16 | | city, village or
incorporated town.
