1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Vehicle Code is amended by adding
5Section 11-1308 as follows:
 
6    (625 ILCS 5/11-1308 new)
7    Sec. 11-1308. Unauthorized use of parking places reserved
8for electric vehicles.
9    (a) For the purposes of this Section:
10    "Electric vehicle" means a battery-powered electric
11vehicle operated solely by electricity or a plug-in hybrid
12electric vehicle that operates on electricity and gasoline and
13has a battery that can be recharged from an external source.
14    "Electric vehicle charging station" means any facility or
15equipment that is used to charge a battery or other energy
16storage device of an electric vehicle.
17    (b) It shall be prohibited to park a non-electric vehicle
18in an electric vehicle charging station designated for use by
19electric vehicles, including an electric vehicle charging
20station on any private or public offstreet parking facility. A
21person may park only an electric vehicle in an electric vehicle
22charging station space designated for use by electric vehicles.
23    (c) Any person or local authority owning or operating any

1public or private offstreet parking facility may, after
2notifying the police or sheriff's department, remove or cause
3to be removed to the nearest garage or other place of safety
4any non-electric vehicle parked within an electric vehicle
5charging station space designated for use by electric vehicles.
6    (d) It shall not be a defense to a charge under this
7Section that the sign or notice posted at the electric vehicle
8charging station or the designated parking space does not
9comply with applicable rules, regulations, or local
10ordinances, if a reasonable person would be made aware by the
11sign or notice on or near the parking space that the space is
12reserved for electric vehicles.
13    (e) Any person found guilty of violating the provisions of
14subsection (b) shall be fined $75 in addition to any costs or
15charges connected with the removal or storage of the
16non-electric vehicle; but municipalities by ordinance may
17impose a fine up to $100.
