| 1 | | AN ACT concerning transportation.
| 2 | | Be it enacted by the People of the State of Illinois,
| 3 | | represented in the General Assembly:
| 4 | | Section 5. The Illinois Vehicle Code is amended by changing | 5 | | Sections 1-187.001, 11-601, 11-601.5, 11-602, and 11-603 as | 6 | | follows:
| 7 | | (625 ILCS 5/1-187.001)
| 8 | | Sec. 1-187.001. Serious traffic violation.
| 9 | | (a) A conviction when operating a motor vehicle for:
| 10 | | (1) a violation of subsection (a) of Section 11-402, | 11 | | relating to a motor
vehicle
accident involving damage to a | 12 | | vehicle;
| 13 | | (2) a violation of Section 11-403, relating to failure | 14 | | to stop and
exchange information after a motor vehicle | 15 | | collision, property damage only;
| 16 | | (3) a violation of subsection (a) of Section 11-502, | 17 | | relating to illegal
transportation, possession, or | 18 | | carrying of alcoholic liquor within the
passenger area of | 19 | | any vehicle;
| 20 | | (4) a violation of Section 6-101 relating to operating | 21 | | a motor vehicle
without a
valid license or permit;
| 22 | | (5) a violation of Section 11-403, relating to failure | 23 | | to stop and
exchange information or give aid after a motor |

| 1 | | vehicle collision involving
personal injury or death;
| 2 | | (6) a violation relating to excessive speeding, | 3 | | involving a single
speeding charge of 26 30 miles per hour | 4 | | or more above the legal speed limit;
| 5 | | (7) a violation relating to reckless driving;
| 6 | | (8) a violation of subsection (d) of Section 11-707, | 7 | | relating to passing
in a no-passing zone;
| 8 | | (9) a violation of subsection (b) of Section 11-1402, | 9 | | relating to
limitations on backing
upon a controlled access | 10 | | highway;
| 11 | | (10) a violation of subsection (b) of Section 11-707, | 12 | | relating to driving
on the left
side of a roadway in a | 13 | | no-passing zone;
| 14 | | (11) a violation of subsection (e) of Section 11-1002, | 15 | | relating to failure
to yield
the right-of-way to a | 16 | | pedestrian at an intersection;
| 17 | | (12) a violation of Section 11-1008, relating to | 18 | | failure to yield to a
pedestrian on a sidewalk; or
| 19 | | (13) a violation of Section 11-1201, relating to | 20 | | failure to stop for an
approaching railroad train or | 21 | | railroad track equipment or signals; or
| 22 | | (b) Any other similar violation of a law or local ordinance | 23 | | of any state
relating to motor vehicle traffic control, other | 24 | | than a parking violation.
| 25 | | (c) A violation of any of these defined serious traffic | 26 | | offenses shall
not preclude the defendant from being eligible |

| 1 | | to receive an order of court
supervision under Section 5-6-1 of | 2 | | the Unified Code of Corrections.

| 5 | | Sec. 11-601. General speed restrictions.
| 6 | | (a) No vehicle may be driven upon any highway of this State | 7 | | at a speed
which is greater than is reasonable and proper with | 8 | | regard to traffic
conditions and the use of the highway, or | 9 | | endangers the safety of any
person or property. The fact that | 10 | | the speed of a vehicle does not exceed
the applicable maximum | 11 | | speed limit does not relieve the driver from the
duty to | 12 | | decrease speed when approaching and crossing an intersection,
| 13 | | approaching and going around a curve, when approaching a hill | 14 | | crest, when
traveling upon any narrow or winding roadway, or | 15 | | when special hazard exists
with respect to pedestrians or other | 16 | | traffic or by reason of weather or
highway conditions. Speed | 17 | | must be decreased as may be necessary to avoid
colliding with | 18 | | any person or vehicle on or entering the highway in
compliance | 19 | | with legal requirements and the duty of all persons to use due
| 20 | | care.
| 21 | | (b) No person may drive a vehicle upon any highway of this | 22 | | State at a
speed which is greater than the applicable statutory | 23 | | maximum speed limit
established by paragraphs (c), (d), (e), | 24 | | (f) or (g) of this Section, by
Section 11-605 or by a | 25 | | regulation or ordinance made under this Chapter.

| 1 | | (c) Unless some other speed restriction is established | 2 | | under this
Chapter, the maximum speed limit in an urban | 3 | | district for all vehicles is:
| 4 | | 1. 30 miles per hour; and
| 5 | | 2. 15 miles per hour in an alley.
| 6 | | (d) Unless some other speed restriction is established | 7 | | under this Chapter,
the maximum speed limit outside an urban | 8 | | district for any vehicle is (1) 65 miles per hour (i) for
all | 9 | | highways under the jurisdiction of the Illinois State Toll
| 10 | | Highway Authority , unless some other speed limit is designated, | 11 | | and (ii) for all or part of highways that are designated by
the | 12 | | Department, have at least 4 lanes of traffic, and have a | 13 | | separation between
the roadways moving in opposite directions | 14 | | and (2) 55 miles per hour for all
other highways, roads, and | 15 | | streets.
| 16 | | (d-1) Unless some other speed restriction is established | 17 | | under this Chapter,
the maximum speed limit outside an urban | 18 | | district for any vehicle is (1) 70 miles per hour on any | 19 | | interstate highway as defined by Section 1-133.1 of this Code; | 20 | | (2) 65 miles per hour for all or part of highways that are | 21 | | designated by the Department, have at least 4 lanes of traffic, | 22 | | and have a separation between the roadways moving in opposite | 23 | | directions; and (3) 55 miles per hour for all other highways, | 24 | | roads, and streets. The counties of Cook, DuPage, Kane, Lake, | 25 | | Madison, McHenry, St. Clair, and Will may adopt ordinances | 26 | | setting a maximum speed limit on highways, roads, and streets |

| 1 | | that is lower than the limits established by this Section. | 2 | | (e) In the counties of Cook, DuPage, Kane, Lake, McHenry, | 3 | | and Will, unless some lesser speed restriction is established | 4 | | under
this
Chapter, the maximum speed limit outside an urban | 5 | | district for a second
division vehicle designed or used for the | 6 | | carrying of a gross weight of
8,001 pounds or more (including | 7 | | the weight of the vehicle and
maximum load) is
55 miles per | 8 | | hour.
| 9 | | (e-1) (Blank). | 10 | | (f) Unless some other speed restriction is established | 11 | | under this Chapter,
the maximum speed limit outside an urban | 12 | | district for a bus is:
| 13 | | 1. 65 miles per hour upon any highway which has at | 14 | | least 4 lanes of
traffic
and of which the roadways for | 15 | | traffic moving in opposite directions are
separated by a | 16 | | strip of ground which is not surfaced or suitable for | 17 | | vehicular
traffic, except that the maximum speed limit for | 18 | | a bus on all highways,
roads, or streets not under the | 19 | | jurisdiction of the Department or the Illinois
State Toll | 20 | | Highway Authority
is 55 miles per hour; and
| 21 | | 1.5. 70 miles per hour upon any interstate highway as | 22 | | defined by Section 1-133.1 of this Code outside the | 23 | | counties of Cook, DuPage, Kane, Lake, McHenry, and Will; | 24 | | and
| 25 | | 2. 55 miles per hour on any other highway.

| 3 | | Sec. 11-601.5. Driving 26 31 miles per hour or more in | 4 | | excess of
applicable limit. | 5 | | (a) A person who drives a vehicle upon any highway of
this | 6 | | State at a speed that is 26 31 miles per hour or more but less | 7 | | than 35 40 miles per hour in excess of
the applicable maximum | 8 | | speed limit established under this Chapter or a
local ordinance | 9 | | commits a Class B misdemeanor. | 10 | | (b) A person who drives a vehicle upon any highway of
this | 11 | | State at a speed that is 35 40 miles per hour or more in excess | 12 | | of
the applicable maximum speed limit established under this | 13 | | Chapter or a
local ordinance commits a Class A misdemeanor.

| 16 | | Sec. 11-602. Alteration of limits by Department. Whenever | 17 | | the Department
determines,
upon the basis of an engineering and | 18 | | traffic investigation concerning any
highway for which the | 19 | | Department has maintenance responsibility, that a
maximum | 20 | | speed limit prescribed in Section 11-601 of this Chapter is | 21 | | greater
or less than is reasonable or safe with respect to the | 22 | | conditions found
to exist at any intersection or other place on | 23 | | such highway or along any
part or zone thereof, the Department | 24 | | shall determine and declare a reasonable
and safe absolute |

| 1 | | maximum speed limit applicable to such intersection or
place, | 2 | | or along such part or zone. However, such limit shall conform | 3 | | with the maximum speed limit restrictions provided for in | 4 | | Section 11-601 of this Code not exceed
65 miles per hour on a
| 5 | | highway or street which is especially
designed for
through | 6 | | traffic and to, from, or over which owners of or persons having
| 7 | | an interest in abutting property or other persons have no right | 8 | | or easement,
or only a limited right or easement, of access, | 9 | | crossing, light, air, or
view, and shall not exceed 55 miles | 10 | | per hour on any other highway . Where
a highway under the | 11 | | Department's jurisdiction
is contiguous to school property, | 12 | | the Department may, at the school district's
request, set a
| 13 | | reduced maximum speed limit for student safety purposes in the | 14 | | portion of the
highway that faces the school property and in | 15 | | the portions of the highway that
extend
one-quarter mile in | 16 | | each direction from the opposite ends of the school
property. A | 17 | | limit determined and
declared as provided in this Section | 18 | | becomes effective, and suspends the
applicability of the limit
| 19 | | prescribed
in Section 11-601 of this Chapter, when appropriate | 20 | | signs giving notice
of the limit are erected at such | 21 | | intersection or other
place, or along such part or zone of the | 22 | | highway. Electronic
speed-detecting devices shall not be used | 23 | | within 500 feet beyond any such
sign in the direction of | 24 | | travel; if so used in violation hereof, evidence
obtained | 25 | | thereby shall be inadmissible in any prosecution for speeding.
| 26 | | However, nothing in this Section prohibits the use of such |

| 1 | | electronic
speed-detecting devices within 500 feet of a sign | 2 | | within a special
school speed zone indicating such zone, | 3 | | conforming to the requirements of
Section 11-605 of this Act, | 4 | | nor shall evidence obtained thereby be
inadmissible in any | 5 | | prosecution for speeding provided the use of such
device shall | 6 | | apply only to the enforcement of the speed limit in such
| 7 | | special school speed zone.

| 10 | | Sec. 11-603. Alteration of limits by Toll Highway | 11 | | Authority.
Whenever the Illinois State Toll Highway Authority
| 12 | | determines, upon the basis of an
engineering and traffic | 13 | | investigation concerning a toll highway under its
| 14 | | jurisdiction, that a maximum speed limit prescribed in Section | 15 | | 11-601 of
this Chapter is greater or less than is reasonable or | 16 | | safe with respect to
conditions found to exist at any place or | 17 | | along any part or zone of such
highway, the Authority shall | 18 | | determine and declare by regulation a
reasonable and safe | 19 | | absolute maximum speed limit at such place or along
such part | 20 | | or zone, and the speed limit shall conform with the maximum | 21 | | speed limit restrictions provided for in Section 11-601 of this | 22 | | Code not exceeding 65 miles per hour . A limit so determined
and | 23 | | declared becomes effective, and suspends the application of the | 24 | | limit
prescribed in Section 11-601 of this Chapter, when (a) | 25 | | the Department
concurs in writing with the Authority's |

| 1 | | regulation, and (b) appropriate
signs giving notice of the | 2 | | limit are erected at such place or along such
part or zone of | 3 | | the highway. Electronic speed-detecting devices shall not
be | 4 | | used within 500 feet beyond any such sign in the direction of | 5 | | travel; if
so used in violation hereof, evidence obtained | 6 | | thereby shall be
inadmissible in any prosecution for speeding.
