1    AN ACT concerning regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Coal Mining Act is amended by changing
5Section 2.05 and by adding Article 40 as follows:
 
6    (225 ILCS 705/2.05)  (from Ch. 96 1/2, par. 305)
7    Sec. 2.05. For the examination of persons seeking
8certificates of competency as mine managers, hoisting
9engineers, and mine examiners, the Board shall hold meetings at
10such times and places within the State as shall, in the
11judgment of the members, afford the best facilities to the
12greatest number of candidates. They shall also call an
13examination at least once a year for electrical hoisting
14engineers and at least twice a year for mine electricians.

20    Sec. 40.1. Mine electrician. Each applicant for a
21certificate of competency as mine electrician shall produce

1evidence of at least one year of experience in performing
2electrical work in a coal mine or acceptable related industry.
3The applicant shall pass an examination as to his or her
4practical and technical knowledge of the nature and properties
5of electricity, direct and alternating currents, electrical
6equipment and circuits, permissibility of electrical
7equipment, the National Electrical Code, and the laws of this
8State relating to coal mine electricity. To be eligible for
9taking a mine electrician examination administered by the State
10Mining Board, the applicant must meet at least one of the
11following criteria:
12        (1) be classified as an apprentice mine electrician and
13    have met the requirements for an apprentice;
14        (2) possess a Bachelor of Science degree in electrical
15    engineering and provide evidence of experience;
16        (3) possess a current coal mine electrician
17    certification from another state coal mine electrical
18    program; or
19        (4) be qualified as a mine electrician, but have not
20    taken a State-approved coal mine electrician examination
21    or a federal coal mine electrician examination.
22        "Qualified mine electrician" means an individual who
23    has completed the required classroom instruction from an
24    approved college or university and can produce evidence of
25    at least one year of experience in performing electrical
26    work in a coal mine or acceptable related industry.

2    Sec. 40.2. Electrical equipment and systems; examination,
3testing, and maintenance. All electrical equipment and systems
4shall be frequently examined and tested and properly maintained
5by a mine electrician to ensure safe operating conditions. When
6a potentially dangerous condition is found in electrical
7equipment or an electrical system, the equipment or system
8shall be removed from service until the condition is corrected.
9A record of the examinations shall be kept and made available
10to the company, the State Mine Inspector, and all other persons
11interested.
