SYNOPSIS AS INTRODUCED:
 
225 ILCS 20/11  from Ch. 111, par. 6361

    Amends the Clinical Social Work and Social Work Practice Act. Provides that no fewer than 3 of the continuing education hours required by the Act must include content that relates to cultural competence in the practice of social work. Provides that no more than 50% of the continuing education hours may be obtained by a method other than face-to-face instruction or other experience, unless a waiver or variance is allowed. Effective immediately.

1    AN ACT concerning regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Clinical Social Work and Social Work
5Practice Act is amended by changing Section 11 as follows:
 
6    (225 ILCS 20/11)  (from Ch. 111, par. 6361)
7    (Section scheduled to be repealed on January 1, 2018)
8    Sec. 11. Licenses; renewal; restoration; person in
9military service; inactive status.
10    (a) The expiration date and renewal period for each license
11issued under this Act shall be set by rule. The licensee may
12renew a license during the 60-day period preceding its
13expiration date by paying the required fee and by demonstrating
14compliance with any continuing education requirements. The
15Department shall adopt rules establishing minimum requirements
16of continuing education and means for verification of the
17completion of the continuing education requirements. No fewer
18than 3 of the continuing education hours must include content
19that relates to cultural competence in the practice of social
20work. In addition, no more than 50% of the continuing education
21hours may be obtained by a method other than face-to-face
22instruction or other experience, unless a waiver or variance is
23allowed. The Department may, by rule, specify circumstances

1under which the continuing education requirements may be
2waived.
3    (b) Any person who has permitted a license to expire or who
4has a license on inactive status may have it restored by
5submitting an application to the Department and filing proof of
6fitness, as defined by rule, to have the license restored,
7including, if appropriate, evidence which is satisfactory to
8the Department certifying the active practice of clinical
9social work or social work in another jurisdiction and by
10paying the required fee.
11    (b-5) If the person has not maintained an active practice
12in another jurisdiction which is satisfactory to the
13Department, the Department shall determine the person's
14fitness to resume active status. The Department may also
15require the person to complete a specific period of evaluated
16clinical social work or social work experience and may require
17successful completion of an examination.
18    (b-7) Notwithstanding any other provision of this Act, any
19person whose license expired while on active duty with the
20armed forces of the United States, while called into service or
21training with the State Militia or in training or education
22under the supervision of the United States government prior to
23induction into the military service may have his or her license
24restored without paying any renewal fees if, within 2 years
25after the honorable termination of that service, training or
26education, except under conditions other than honorable, the

1Department is furnished with satisfactory evidence that the
2person has been so engaged and that the service, training or
3education has been so terminated.
4    (c) A license to practice shall not be denied any applicant
5because of the applicant's race, religion, creed, national
6origin, political beliefs or activities, age, sex, sexual
7orientation, or physical impairment.
8    (d) (Blank).

11    (g) The Department shall indicate on each license the
12academic degree of the licensee.

14    Section 99. Effective date. This Act takes effect upon
15becoming law.
