SYNOPSIS AS INTRODUCED:

35 ILCS 5/507DDD new

    Amends the Illinois Income Tax Act. Creates an income tax checkoff to allow taxpayers to make contributions to the Illinois Women's Military and Civilian Memorial Fund. Provides that moneys in the Fund may be used by the Department of Veterans' Affairs to make grants for the purposes of (i) constructing an Illinois Women's Military and Civilian Memorial in Oak Ridge Cemetery, Springfield, Illinois, and (ii) compiling a registry of persons who are eligible for commemoration as part of the memorial. Amends the State Finance Act to create the Fund. Effective immediately.

1    AN ACT concerning revenue.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The State Finance Act is amended by adding
5Section 5.866 as follows:
 
6    (30 ILCS 105/5.866 new)
7    Sec. 5.866. The Illinois Women's Military and Civilian
8Memorial Fund.
 
9    Section 10. The Illinois Income Tax Act is amended by
10adding Section 507DDD as follows:
 
11    (35 ILCS 5/507DDD new)
12    Sec. 507DDD. Illinois Women's Military and Civilian
13Memorial Fund checkoff. For taxable years ending on or after
14December 31, 2014, the Department must print on its standard
15individual income tax form a provision (i) indicating that if
16the taxpayer wishes to contribute to the Illinois Women's
17Military and Civilian Memorial Fund, a special fund created in
18the State treasury, as authorized by this amendatory Act of the
1998th General Assembly, he or she may do so by stating the
20amount of the contribution (not less than $1) on the return and
21(ii) stating that the contribution will reduce the taxpayer's

1refund or increase the amount of payment to accompany the
2return. Failure to remit any amount of increased payment shall
3reduce the contribution accordingly. This Section does not
4apply to any amended return.
5    Notwithstanding any other provision of law, moneys
6deposited into the Illinois Women's Military and Civilian
7Memorial Fund from contributions under this Section shall be
8used by the Department of Veterans' Affairs to make grants for
9the purposes of (i) constructing an Illinois Women's Military
10and Civilian Memorial in Oak Ridge Cemetery, Springfield,
11Illinois, and (ii) compiling a registry of persons who are
12eligible for commemoration as part of the memorial.
 
13    Section 99. Effective date. This Act takes effect upon
14becoming law.
