SYNOPSIS AS INTRODUCED:
 
65 ILCS 5/11-80-24 new

    Amends the Illinois Municipal Code. Provides that no bicycle sharing system may operate a docking station in an area with posted signs that expressly prohibit parking at any time or during certain hours that is adjacent to any elementary or secondary school in any municipality. Defines "bicycle sharing system" and "docking station". Preempts home rule powers.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Municipal Code is amended by adding
5Section 11-80-24 as follows:
 
6    (65 ILCS 5/11-80-24 new)
7    Sec. 11-80-24. Bicycle sharing systems. No bicycle sharing
8system may operate a docking station in an area with posted
9signs that expressly prohibit parking at any time or during
10certain hours that is adjacent to any elementary or secondary
11school in any municipality.
12    For purposes of this Section:
13    "Bicycle sharing system" means a fleet of bicycles that are
14locked into a network of docking stations that may be rented
15from and returned to any station in the system.
16    "Docking station" includes, but is not limited to, a
17touch-screen kiosk, station map, and a docking system that
18releases bicycles using a member key or code.
19    A home rule municipality may not regulate bicycle sharing
20systems. This Section is a denial and limitation of home rule
21powers and functions under subsection (h) of Section 6 of
22Article VII of the Illinois Constitution.
