SYNOPSIS AS INTRODUCED:
 
70 ILCS 3615/5.06 new
30 ILCS 805/8.38 new

    Amends the Regional Transportation Authority Act. Provides that the Authority shall, within 12 months of the effective date of this amendatory Act, create a website known as the Greater Chicago Mass Transit Transparency and Accountability Portal (CHI-TAP). Requires the website to contain a database of information concerning the number of employees employed by the Authority and its Service Boards, employing entity and division, and salary information. Provides the website must contain other information including contracts, expenditures, and safety and accident information required to be reported under federal law.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Regional Transportation Authority Act is
5amended by adding Section 5.06 as follows:
 
6    (70 ILCS 3615/5.06 new)
7    Sec. 5.06. Greater Chicago Mass Transit Transparency and
8Accountability Portal (CHI-TAP).
9    (a) The Authority, within 12 months after the effective
10date of this amendatory Act of the 98th General Assembly, shall
11establish and maintain a website, known as the Greater Chicago
12Mass Transit Transparency and Accountability Portal (CHI-TAP),
13with a full-time webmaster tasked with compiling and updating
14the CHI-TAP database with information received from the
15Authority and all of its Service Boards.
16    (b) For purposes of this Section:
17        "Contracts" means payment obligations with vendors on
18    file with the Office of the Comptroller to purchase goods
19    and services exceeding $10,000 in value (or, in the case of
20    professional or artistic services, exceeding $5,000 in
21    value).
22        "Appropriation" means line-item detail of spending
23    approved by the General Assembly and Governor, categorized

1    by object of expenditure.
2        "Individual consultants" means temporary workers
3    eligible to receive State benefits paid on a State payroll.
4        "Recipients" means the Authority or any of its Service
5    Boards receiving appropriations.
6    (c) The CHI-TAP shall provide direct access to each of the
7following:
8        (1) A database of all current employees and individual
9    consultants of the Authority and its Service Boards, sorted
10    separately by:
11            (i) Name.
12            (ii) Employing entity.
13            (iii) Employing division.
14            (iv) Employment position title.
15            (v) Current pay rate and year-to-date pay.
16        (2) A database of all current Authority expenditures,
17    sorted separately by Service Board, category, recipient,
18    and Representative District.
19        (3) A database of all development assistance
20    reportable pursuant to the Corporate Accountability for
21    Tax Expenditures Act, sorted separately by tax credit
22    category, taxpayer, and Representative District.
23        (4) A database of all current Authority and Service
24    Board contracts, sorted separately by contractor name,
25    awarding officer or agency, contract value, and goods or
26    services provided.

1        (5) A database of all employees of the Authority and
2    its Service Boards hired on or after the effective date of
3    this amendatory Act of the 98th General Assembly, sorted
4    searchably by each of the following at the time of
5    employment:
6            (i) Name.
7            (ii) Employing entity.
8            (iii) Employing division.
9            (iv) Employment position title.
10            (v) Current pay rate and year-to-date pay.
11            (vi) County of employment location.
12            (vii) Rutan status.
13            (viii) Status of position as subject to collective
14        bargaining, subject to merit compensation, or exempt
15        under Section 4d of the Personnel Code.
16            (ix) Employment status as probationary, trainee,
17        intern, certified, or exempt from certification.
18            (x) Status as a military veteran.
19        (6) A database of all accident-related and
20    safety-related information currently required to be
21    reported to the federal Secretary of Transportation under
22    49 U.S.C. 5335.
23    (d) The CHI-TAP shall include all information required to
24be published by subsection (c) of this Section that is
25available to the Authority in a format the Authority can
26compile and publish on the CHI-TAP. The Authority shall update

1the CHI-TAP as additional information becomes available in a
2format that can be compiled and published on the CHI-TAP by the
3Authority.
4    (e) Each Service Board shall cooperate with the Authority
5in furnishing the information necessary for the implementation
6of this Section within a timeframe specified by the Authority.
7    (f) The Authority and its Service Boards submitting
8information to be displayed on CHI-TAP are responsible for the
9accuracy of the information provided.
 
10    Section 90. The State Mandates Act is amended by adding
11Section 8.38 as follows:
 
12    (30 ILCS 805/8.38 new)
13    Sec. 8.38. Exempt mandate. Notwithstanding Sections 6 and 8
14of this Act, no reimbursement by the State is required for the
15implementation of any mandate created by this amendatory Act of
16the 98th General Assembly.
