SYNOPSIS AS INTRODUCED:
 
70 ILCS 705/11  from Ch. 127 1/2, par. 31
225 ILCS 447/10-10

    Amends the Fire Protection District Act. Provides that the board may adopt ordinances regulating the supervision and monitoring of fire alarm systems maintained within the district. Allows the board to collect reasonable fees for fire alarm services that are provided to customers by the district itself or through a vendor approved by the board. Amends the Private Detective, Private Alarm, Private Security, Fingerprint Vendor, and Locksmith Act of 2004. Exempts from the requirements of the Act a unit of local government or its employee that directly engages in fire alarm supervision and monitoring pursuant to an ordinance adopted under the Fire Protection District Act. Effective immediately.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Fire Protection District Act is amended by
5changing Section 11 as follows:
 
6    (70 ILCS 705/11)  (from Ch. 127 1/2, par. 31)
7    Sec. 11. The board of trustees of any fire protection
8district incorporated under this Act has the power and it is
9its legal duty and obligation to provide as nearly adequate
10protection from fire for all persons and property within the
11said district as possible and to prescribe necessary
12regulations for the prevention and control of fire therein.
13    (a) The board of trustees may provide and maintain life
14saving and rescue equipment, services and facilities,
15including an emergency ambulance service.
16    (b) Except in cities having a population of 500,000 or more
17inhabitants and except in municipalities in which fire
18prevention codes have been adopted, the board of trustees has
19the express power to adopt and enforce fire prevention codes
20and standards parallel to national standards.
21    (c) The board of trustees may adopt ordinances regulating
22the supervision and monitoring of fire alarm systems maintained
23within the district's boundaries. The board may collect

1reasonable fees for fire alarm monitoring services that are
2provided to customers either directly by the district or
3through a vendor approved by the board.

5    Section 10. The Private Detective, Private Alarm, Private
6Security, Fingerprint Vendor, and Locksmith Act of 2004 is
7amended by changing Section 10-10 as follows:
 
8    (225 ILCS 447/10-10)
9    (Section scheduled to be repealed on January 1, 2024)
10    Sec. 10-10. General exemptions. This Act does not apply to
11any of the following:
12        (1) A person, firm, or corporation engaging in fire
13    protection engineering, including the design, testing, and
14    inspection of fire protection systems.
15        (2) The practice of professional engineering as
16    defined in the Professional Engineering Practice Act of
17    1989.
18        (3) The practice of structural engineering as defined
19    in the Structural Engineering Practice Act of 1989.
20        (4) The practice of architecture as defined in the
21    Illinois Architecture Practice Act of 1989.
22        (5) The activities of persons or firms licensed under
23    the Illinois Public Accounting Act if performed in the
24    course of their professional practice.

1        (6) An attorney licensed to practice in Illinois while
2    engaging in the practice of law.
3        (7) A person engaged exclusively and employed by a
4    person, firm, association, or corporation in the business
5    of transporting persons or property in interstate commerce
6    and making an investigation related to the business of that
7    employer.
8        (8) A person who provides canine odor detection
9    services to a unit of federal, State, or local government
10    on an emergency call-out or volunteer and not-for-hire
11    basis.
12        (9) Any unit of local government or employee of a unit
13    of local government that directly engages in fire alarm
14    supervision and monitoring as permitted under an ordinance
15    adopted under Section 11 of the Fire Protection District
16    Act.

18    Section 99. Effective date. This Act takes effect upon
19becoming law.
