    Amends the Counties Code. Provides that all counties with a population of less than 1,000,000 may incur an indebtedness for the construction, expansion, or remodeling of a county jail and sheriff's residence, subject to a backdoor referendum (now, counties with a population of less than 80,000 may incur indebtedness for the construction of a county jail and sheriff's residence only by a direct referendum). Provides that counties with a population of 500,000 or more inhabitants, but less than 1,000,000 inhabitants, may incur an indebtedness for the construction, expansion, or remodeling of a county jail (instead of just construction or remodeling of a county jail). Provides that all counties may incur indebtedness for the reconstruction and remodeling of an existing courthouse or the construction of a new courthouse, subject to a backdoor referendum (now, counties with a population of less than 300,000 may incur that indebtedness only by a direct referendum). Makes a technical correction. Effective immediately.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Counties Code is amended by changing
5Sections 6-3001, 6-3005, 6-4001, and 6-4003 as follows:
 
6    (55 ILCS 5/6-3001)  (from Ch. 34, par. 6-3001)
7    Sec. 6-3001. Counties of 80,000 but less than 500,000;
8Bonds for jail and sheriff's residence. Any county having a
9population of 80,000 or more inhabitants, but less than 500,000
10inhabitants may by resolution of its county board incur an
11indebtedness for the construction, expansion, or remodeling of
12a county jail and sheriff's residence, and may issue and sell
13its bonds and levy taxes upon all the taxable property of such
14county sufficient to pay the principal thereof at maturity and
15to pay interest thereon as it falls due but the total amount of
16such bonds, together with existing indebtedness, shall not
17exceed the limitation provided by law for indebtedness of such
18county. Taxes levied for the payment of the interest on and
19principal of such bonds shall be in addition to the maximum of
20taxes provided by statute for counties and shall not be subject
21to the limitation for county taxes provided in Section 5-1024
225-1020. In addition, a county having a population of 240,000 or
23more inhabitants bordering on the Mississippi River may by

1resolution of its county board incur an indebtedness and issue
2and sell bonds for the expansion or remodeling of a county jail
3and sheriff's residence.

6    Sec. 6-3005. Counties of 500,000 or more but less than
71,000,000; bonds for construction or remodeling of county
8jails. Any county with a population of 500,000 or more
9inhabitants, but less than 1,000,000 inhabitants may by
10resolution of its county board incur an indebtedness for the
11construction, expansion, or remodeling of a county jail and for
12the acquisition of land and fixtures therefor, and may issue
13and sell bonds therefor, and levy taxes upon all taxable
14property of the county sufficient to pay the principal on bonds
15at maturity and to pay the interest thereon as it falls due.

18    Sec. 6-4001. Bonds for construction or remodeling of
19courthouses. Any county with a population of more than 300,000
20and an increase in population of 30% or more from any decennial
21census to the next such census, by resolution of its county
22board may incur indebtedness for the reconstruction and
23remodeling of an existing courthouse or the construction of a
24new courthouse and related facilities at the same or a new

1location and for the acquisition of land and fixtures therefor,
2issue and sell general obligation bonds therefor and levy taxes
3upon all taxable property of the county sufficient to pay the
4principal on the bonds at maturity and to pay interest thereon
5as it falls due.

8    Sec. 6-4003. Tax levy. The resolution authorizing the bonds
9shall also provide for the levy and collection of a direct
10annual tax upon all taxable property in the county sufficient
11to pay the principal of the bonds at maturity and to pay the
12interest thereon as it falls due. Such tax shall not exceed
13.05% of the value of the property as equalized or assessed by
14the Department of Revenue, but shall not be subject to any
15other statutory limitations relative to taxes which may be
16extended for county purposes, and shall not be subject to the
17limitations provided in Section 5-1024 5-1020. The tax may be
18levied without referendum.
