1    AN ACT concerning regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Pawnbroker Regulation Act is amended by
5adding Section 20 as follows:
 
6    (205 ILCS 510/20 new)
7    Sec. 20. Precious Metal Purchasers Task Force.
8    (a) The General Assembly finds:
9        (1) There has been, and continues to be, a significant
10    expansion in the volume of precious metals and jewelry sold
11    through pawnbrokers, auction services, for-profit
12    consignment sellers, and other resellers.
13        (2) There has been, and continues to be, a similar
14    increase in the volume of stolen precious metals and
15    jewelry.
16        (3) Access by law enforcement to sales-related
17    information generated by pawnbrokers, auction services,
18    for-profit consignment sellers, and other resellers has
19    always been an important tool in combating burglary,
20    robbery, theft, and other crimes directed at personal
21    property.
22        (4) Recent advances in electronic data collection and
23    compilation have greatly simplified both the reporting of

1    sales-related information by pawnbrokers, auction
2    services, for-profit consignment sellers, and other
3    resellers.
4        (5) Law enforcement agencies, pawnbrokers, auction
5    services, for-profit consignment sellers, resellers, and
6    information technology-related businesses in several
7    states have created differing systems to provide law
8    enforcement with timely access to sales-related
9    information.
10    (b) There is hereby created the Precious Metal Purchasers
11Task Force, consisting of members appointed as follows:
12        (1) two members from the Senate, one appointed by the
13    Senate President and one appointed by the Minority Leader;
14        (2) two members from the House of Representatives, one
15    appointed by the Speaker of the House and one appointed by
16    the Minority Leader;
17        (3) one member appointed by the Governor as chairperson
18    of the task force;
19        (4) one member appointed by the Secretary of State;
20        (5) one member appointed by the Attorney General;
21        (6) one member appointed by the Secretary of Financial
22    and Professional Regulation from the Department of
23    Financial and Professional Regulation;
24        (7) one member appointed by the Director of State
25    Police from the Department of State Police;
26        (8) one member from a statewide organization

1    representing the Chiefs of Police appointed by the
2    Governor;
3        (9) one member recommended by the Illinois Municipal
4    League and appointed by the Governor;
5        (10) one member of an association representing the
6    interests of pawnbrokers appointed by the Governor;
7        (11) one member representing the interests of
8    for-profit consignment shops appointed by the Governor;
9        (12) one member representing the interests of the
10    insurance industry with a strong vested interest in
11    stopping theft and recovering stolen goods appointed by the
12    Governor;
13        (13) two members representing the interests of the
14    general public appointed by the Governor;
15        (14) one member representing the interests of the scrap
16    recycling industry appointed by the Governor;
17        (15) one member of a statewide association exclusively
18    representing retailers appointed by the Governor; and
19        (16) one member of an association representing
20    numismatic shops appointed by the Governor.
21    All members appointed under this Section shall serve
22without compensation, and may be reimbursed for their
23reasonable and necessary expenses from funds appropriated from
24the Pawnbroker Regulation Fund.
25    (c) The task force shall study the various systems,
26technologies, and methods of operation for providing law

1enforcement with the timely access to information relating to
2the sales of precious metals and jewelry by pawnbrokers,
3auction sellers, for-profit consignment sellers, resellers,
4and other persons or entities as it may deem fit, including,
5but not limited to, providers of technology and services
6relating to the collection, compilation, storage, and access to
7such information.
8    (d) The Department of Financial and Professional
9Regulation shall provide any necessary administrative and
10other support to the task force.
11    (e) On or before December 31, 2013, the task force shall
12file and present a report to the General Assembly concerning
13its recommendations regarding the systems and technologies,
14together with their usage and potential funding mechanisms and
15sources, to be implemented to create a statewide system for the
16collection of information of the sales of precious metals and
17jewelry by pawnbrokers, auction services, for-profit
18consignment sellers, and other resellers, and for the
19compilation, storage, and timely access to that information by
20law enforcement and shall include proposed legislation to
21implement its recommendations, if needed.
22    (f) This Section is repealed on December 31, 2014.
 
23    Section 99. Effective date. This Act takes effect upon
24becoming law.
