SYNOPSIS AS INTRODUCED:
 
5 ILCS 430/50-5

    Amends the State Officials and Employees Ethics Act. Provides that the Executive Ethics Commission may levy an administrative fine of (i) $250 against any officer, member, or employee under the jurisdiction of the Commission who fails to complete the ethics training within 30 days after the deadline set by the Commission for the completion of that training, (ii) $350 against any officer, member, or employee under the jurisdiction of the Commission who fails to complete the ethics training within 31 to 60 days after the deadline set by the Commission for the completion of that training, and (iii) $500 against any officer, member, or employee under the jurisdiction of the Commission who fails to complete the ethics training more than 61 days after the deadline set by the Commission for the completion of that training.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The State Officials and Employees Ethics Act is
5amended by changing Section 50-5 as follows:
 
6    (5 ILCS 430/50-5)
7    Sec. 50-5. Penalties.
8    (a) A person is guilty of a Class A misdemeanor if that
9person intentionally violates any provision of Section 5-15,
105-30, 5-40, or 5-45 or Article 15.
11    (a-1) An ethics commission may levy an administrative fine
12for a violation of Section 5-45 of this Act of up to 3 times the
13total annual compensation that would have been obtained in
14violation of Section 5-45.
15    (b) A person who intentionally violates any provision of
16Section 5-20, 5-35, 5-50, or 5-55 is guilty of a business
17offense subject to a fine of at least $1,001 and up to $5,000.
18    (c) A person who intentionally violates any provision of
19Article 10 is guilty of a business offense and subject to a
20fine of at least $1,001 and up to $5,000.
21    (d) Any person who intentionally makes a false report
22alleging a violation of any provision of this Act to an ethics
23commission, an inspector general, the State Police, a State's

1Attorney, the Attorney General, or any other law enforcement
2official is guilty of a Class A misdemeanor.
3    (e) An ethics commission may levy an administrative fine of
4up to $5,000 against any person who violates a provision of
5this Act other than Section 5-10, who intentionally obstructs
6or interferes with an investigation conducted under this Act by
7an inspector general, or who intentionally makes a false,
8frivolous, or bad faith allegation.
9    (f) In addition to any other penalty that may apply,
10whether criminal or civil, a State employee who intentionally
11violates any provision of Section 5-5, 5-15, 5-20, 5-30, 5-35,
125-45, or 5-50, Article 10, Article 15, or Section 20-90 or
1325-90 is subject to discipline or discharge by the appropriate
14ultimate jurisdictional authority.
15    (g) The Executive Ethics Commission may levy an
16administrative fine of:
17        (1) $250 against any officer, member, or employee under
18    the jurisdiction of the Commission who fails to complete
19    the ethics training required under Section 5-10 within 30
20    days after the deadline set by the Commission for the
21    completion of that training;
22        (2) $350 against any officer, member, or employee under
23    the jurisdiction of the Commission who fails to complete
24    the ethics training required under Section 5-10 within 31
25    to 60 days after the deadline set by the Commission for the
26    completion of that training; and

1        (3) $500 against any officer, member, or employee under
2    the jurisdiction of the Commission who fails to complete
3    the ethics training required under Section 5-10 more than
4    61 days after the deadline set by the Commission for the
5    completion of that training.
