1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The School Code is amended by changing Section
514-1.09.2 as follows:
 
6    (105 ILCS 5/14-1.09.2)
7    Sec. 14-1.09.2. School Social Work Services. In the public
8schools, social work services may be provided by qualified
9specialists who hold Type 73 School Service Personnel
10Certificates endorsed for school social work issued by the
11State Teacher Certification Board or who hold a Professional
12Educator License with a school support personnel endorsement in
13the area of school social worker under Section 21B-25 of this
14Code.
15    School social work services may include, but are not
16limited to:
17        (1) Identifying students in need of special education
18    services by conducting a social-developmental study in a
19    case study evaluation;
20        (2) Developing and implementing comprehensive
21    interventions with students, parents, and teachers that
22    will enhance student adjustment to, and performance in, the
23    school setting;

1        (3) Consulting and collaborating with teachers and
2    other school personnel regarding behavior management and
3    intervention plans and inclusion in support of special
4    education students in regular classroom settings;
5        (4) Counseling with students, parents, and teachers in
6    accordance with the rules and regulations governing
7    provision of related services, provided that parent
8    permission must be obtained in writing before a student
9    participates in a group counseling session;
10        (5) Acting as a liaison between the public schools and
11    community resources;
12        (6) Developing and implementing school-based
13    prevention programs, including mediation and violence
14    prevention, implementing social and emotional education
15    programs and services, and establishing and implementing
16    bullying prevention and intervention programs;
17        (7) Providing crisis intervention within the school
18    setting;
19        (8) Supervising school social work interns enrolled in
20    school social work programs that meet the standards
21    established by the State Board of Education;
22        (9) Providing parent education and counseling as
23    appropriate in relation to the child's educational
24    assessment; and
25        (10) Assisting in completing a functional behavioral
26    assessment, as well as assisting in the development of

1    nonaversive behavioral intervention strategies; and .
2        (11) Evaluating program effectiveness.
3    Nothing in this Section prohibits other certified
4professionals from providing any of the services listed in this
5Section for which they are appropriately trained.

7    Section 10. The Children's Mental Health Act of 2003 is
8amended by changing Section 15 as follows:
 
9    (405 ILCS 49/15)
10    Sec. 15. Mental health and schools.
11    (a) The Illinois State Board of Education shall develop and
12implement a plan to incorporate social and emotional
13development standards as part of the Illinois Learning
14Standards for the purpose of enhancing and measuring children's
15school readiness and ability to achieve academic success. The
16plan shall be submitted to the Governor, the General Assembly,
17and the Partnership by December 31, 2004.
18    (b) Every Illinois school district shall develop a policy
19for incorporating social and emotional development into the
20district's educational program. The policy shall address
21teaching and assessing social and emotional skills and
22protocols for responding to children with social, emotional, or
23mental health problems, or a combination of such problems, that
24impact learning ability. School social workers may implement a

1continuum of social and emotional education programs and
2services in accordance with students' needs. Each district must
3submit this policy to the Illinois State Board of Education by
4August 31, 2004.

6    Section 99. Effective date. This Act takes effect upon
7becoming law.
