1    AN ACT concerning business.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 1. Short title. This Act may be cited as the
5Self-Administered Sexual Assault Evidence Collection Kit Ban
6Act.
 
7    Section 5. Definition. As used in this Act,
8"self-administered sexual assault evidence collection kit"
9means materials advertised or marketed as a means for a
10person, other than a medical professional, to collect physical
11evidence of a sexual assault.
 
12    Section 10. Prohibition on the sale of self-administered
13sexual assault evidence collection kits. It is unlawful for
14any person to sell, market, promote, advertise, or otherwise
15distribute a self-administered sexual assault evidence
16collection kit to a consumer in this State.
 
17    Section 15. Private right of action. A person aggrieved by
18a violation of this Act by a seller of a self-administered
19sexual assault evidence collection kit may file suit in
20circuit court in the county where the alleged offense occurred
21or where any person who is a party to the action resides. An

1action may be brought by one or more persons for and on behalf
2of themselves and other persons similarly situated. A person
3aggrieved by a violation of this Act is entitled to collect:
4        (1) compensatory damages in the amount of any payments
5    made to the seller of a self-administered sexual assault
6    evidence collection kit;
7        (2) punitive damages, not to exceed $1,000 for each
8    violation of this Act; and
9        (3) attorney's fees and costs.
 
10    Section 20. Enforcement.
11    (a) The Attorney General or the State's Attorney of the
12county where the purchaser of a self-administered sexual
13assault evidence collection kit resides may file a complaint
14in the circuit court in the county where the alleged offense
15occurred for:
16        (1) injunctive relief to restrain violations of this
17    Act;
18        (2) a civil penalty, not to exceed $1,500 for each
19    violation of this Act; and
20        (3) any other relief as may be required.
21    (b) Upon the commencement of any action under this Section
22by a State's Attorney, the State's Attorney shall mail a copy
23of the complaint or other initial pleading to the Attorney
24General, and upon the entry of any judgment or order in the
25action, shall mail a copy of the judgment or order to the

2    Section 99. Effective date. This Act takes effect January
31, 2026.
