SYNOPSIS AS INTRODUCED:
 
65 ILCS 5/11-80-25 new
220 ILCS 5/8-513 new

    Amends the Illinois Municipal Code. Provides that the corporate authorities of each municipality may use a public utility's utility pole within the municipality's public rights-of-way for municipal public safety purposes, including, but not limited to, the placing of equipment associated with public safety. Provides that any fee charged by a public utility for the use of a utility pole by the municipality under the provisions shall be at the lowest rate charged by the public utility owing the utility pole and shall not exceed the public utility's actual costs. Amends the Public Utilities Act to make a conforming change.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Municipal Code is amended by
5adding Section 11-80-25 as follows:
 
6    (65 ILCS 5/11-80-25 new)
7    Sec. 11-80-25. Municipal use of utility pole for municipal
8public safety.
9    (a) As used in this Section, "public utility" has the
10meaning given to that term in Section 3-105 of the Public
11Utilities Act.
12    (b) The corporate authorities of a municipality may use a
13public utility's utility pole within the municipality's public
14rights-of-way for municipal public safety purposes, including,
15but not limited to, the placing of equipment associated with
16public safety.
17    (c) Any fee charged by a public utility for the use of a
18utility pole by a municipality under this Section shall be at
19the lowest rate charged by the public utility owning the
20utility pole and shall not exceed the public utility's actual
21costs.
 
22    Section 10. The Public Utilities Act is amended by adding

3    Sec. 8-513. Utility obligations for municipal public
4safety. Public utilities shall provide municipalities with the
5use of any utility pole within the municipality's public
6rights-of-way as provided in Section 11-80-25 of the Illinois
7Municipal Code.
