SENATE RESOLUTION NO. 25

 
2    BE IT RESOLVED, BY THE SENATE OF THE NINETY-SEVENTH GENERAL
3ASSEMBLY OF THE STATE OF ILLINOIS, that the Rules of the Senate
4of the 97th General Assembly are amended by changing Rule 10-2
5as follows:
 
 
6    (Senate Rule 10-2)
7    10-2. Appointment Messages.
8    (a) Every nomination subject to the advice and consent of
9the Senate shall be submitted to the Senate by an Appointment
10Message from the appointing officer or appointing authority in
11accordance with this Rule, using the Appointment Message form
12provided in this Rule, containing all of the required
13information, and accompanied by a cover letter signed by the
14appointing officer or on behalf of the appointing authority.
 
15    (b) All Appointment Messages shall be drafted by the
16Legislative Reference Bureau, according to the form provided in
17this Rule.
 
18    (c) Appointment Messages submitted shall be assigned a
19sequential number by the Secretary of the Senate, indicating
20the order in which they were received and read into the Senate
21record by the Secretary of the Senate at the direction of the

1Senate President. An Appointment Message is received by the
2Senate when it is read into the Senate record and assigned a
3sequential number.
 
4    (d) An Appointment Message that does not conform to the
5requirements of this Rule shall, at the direction of the Senate
6President, (i) be ruled non-compliant and of no legal effect
7and (ii) returned by the Secretary of the Senate to the
8appointing officer or authority that filed it.
 
9    (e) The appointing officer or authority may file in
10accordance with this Rule an Appointment Message that
11supersedes a previously filed Appointment Message. A
12superseding Appointment Message shall identify by sequential
13number the Appointment Message that it supersedes. The filing
14of a superseding Appointment Message shall automatically table
15the Appointment Message that it supersedes, and that superseded
16Appointment Message shall have no further legal effect.
 
17    (f) Nothing in this Rule shall be construed to prohibit an
18appointing officer or authority from withdrawing in writing an
19Appointment Message that was previously submitted to or
20received by the Senate. An Appointment Message that has been
21withdrawn shall have no further legal effect.
 
22    (g) An Appointment Message (i) shall be a

1committee-sponsored legislative measure that is unamendable
2and (ii) shall be controlled by the Chairperson of the
3Executive Appointments Committee, who for purposes of these
4Senate Rules shall be deemed the principal sponsor. In the
5absence of the Chairperson, the Vice-Chairperson of the
6Executive Appointments Committee shall be deemed the principal
7sponsor. Messages may not have individual cosponsors.
 
8    (h) Any Appointment Message pending when the Senate
9adjourns sine die (i) shall carry over into the next General
10Assembly and (ii) shall be considered to have been received by
11the Senate when originally read into the Senate record as
12provided for in subsection (c) of this Rule. An Appointment
13Message carrying over into the next General Assembly shall
14retain the sequential number assigned when originally read into
15the Senate record as provided for in subsection (c) of this
16Rule.
 
17    (i) Notwithstanding the requirements contained in this
18Rule, any Appointment Message submitted to the 96th General
19Assembly and not acted upon by the 96th General Assembly is
20deemed to be carried over to the 97th General Assembly. The
21Senate may take action on any Appointment Message carried over
22from the Senate of the 96th General Assembly. Nothing in this
23Rule shall be construed to prohibit an appointing officer or
24authority from withdrawing in writing an Appointment Message

1that was previously submitted to or received by the Senate of
2the 96th General Assembly and carried over into the Senate of
3the 97th General Assembly. An Appointment Message carried over
4from the Senate of the 96th General Assembly that has been
5withdrawn in the Senate of the 97th General Assembly shall have
6no further legal effect.
 
7    (j) Form.

1accompanied by a cover letter signed by the appointing officer
2or on behalf of the appointing authority.
 
3    (b) All Appointment Messages shall be drafted by the

16appointing officer or authority that filed the same by the
17Secretary of the Senate.
 
18    (e) The appointing officer or authority may file in
19accordance with this rule an Appointment Message which
20supersedes a previously filed Appointment Message. A
21superseding Appointment Message shall identify by number the

2Appointment Message which it supersedes, and that message shall
3have no further legal effect.
 
4    (f) An Appointment Message shall be a committee-sponsored
5legislative measure which is unamendable, and shall be
6controlled by the Chairperson of the Executive Appointments
7Committee, who for purposes of these Senate Rules shall be
8deemed the principal sponsor or, in the absence of the
9Chairperson, the Vice-Chairperson of the Executive
10Appointments Committee shall be deemed the principal sponsor.
11Messages may not have individual cosponsors.
 
12    (g) Any Appointment Message pending when the Senate
13adjourns sine die shall automatically be tabled, and that
14message shall have no further legal effect. An appointing
15officer or authority shall file a new Appointment message in
16accordance with the Senate Rules of the new General Assembly if
17they wish for the nomination to be considered by the Senate for
18confirmation.
