SYNOPSIS AS INTRODUCED:
 
20 ILCS 1305/1-55 new

    Amends the Department of Human Services Act. Provides that consistent with the objectives of budgeting for outcomes, as soon as practicable after the effective date of this amendatory Act, the Department of Human Services, in coordination with the Governor's Office of Management and Budget, shall undertake a review of the Department's contracts and grants to assess which contracts and grants, and categories thereof, are appropriate candidates for the implementation of a performance-based contract evaluation model. Requires the Department to refine current performance metrics and develop new metrics for programs, including contracts and grants that fall within the categories determined to be appropriate by the Governor's Office of Management and Budget and the Department. Provides that starting in State Fiscal Year 2013, Community Services Agreements shall explicitly outline performance reporting requirements, detailing the specific performance metrics to be reported, the method for submitting metrics, and the frequency of the metrics reporting. Provides that these provisions shall be applicable to all contracts and grants funded by the Department in an estimated amount in excess of $100,000. Effective immediately.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Department of Human Services Act is amended
5by adding Section 1-55 as follows:
 
6    (20 ILCS 1305/1-55 new)
7    Sec. 1-55. Contract performance metrics.
8    (a) Consistent with the objectives of budgeting for
9outcomes, as soon as practicable after the effective date of
10this amendatory Act of the 97th General Assembly, the
11Department of Human Services, in coordination with the
12Governor's Office of Management and Budget, shall undertake a
13review of the Department's contracts and grants to assess which
14contracts and grants, and categories thereof, are appropriate
15candidates for the implementation of a performance-based
16contract evaluation model.
17    (b) The Department shall refine current performance
18metrics and develop new metrics for programs, including
19contracts and grants that fall within the categories determined
20to be appropriate by the Governor's Office of Management and
21Budget and the Department under subsection (a). Performance
22metrics may be based on required program components and a
23methodology that incorporates the reasonable costs of the

1required program components.
2    (c) The Department shall ensure that service contracts and
3agreements, as deemed appropriate under subsection (a),
4include performance reporting requirements. Starting in State
5Fiscal Year 2013, Community Services Agreements shall
6explicitly outline performance reporting requirements,
7detailing the specific performance metrics to be reported, the
8method for submitting metrics, and the frequency of the metrics
9reporting.
10    (d) The Department shall enhance its processes to monitor
11and address noncompliance with reporting requirements and with
12program performance standards. Where applicable, the process
13may include a corrective action plan. The monitoring process
14shall include a plan for tracking and documenting
15performance-based contracting decisions.
16    (e) Notwithstanding any other provision of this Section,
17the provisions of this Section shall be applicable to all
18contracts and grants funded by the Department in an estimated
19amount in excess of $100,000.
 
20    Section 99. Effective date. This Act takes effect upon
21becoming law.
