1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The School Code is amended by changing Section
529-6.3 as follows:
 
6    (105 ILCS 5/29-6.3)
7    Sec. 29-6.3. Transportation to and from specified
8interscholastic or school-sponsored activities.
9        (a) Any school district transporting students in grade
1012 or below for an interscholastic, interscholastic athletic,
11or school-sponsored, noncurriculum-related activity that (i)
12does not require student participation as part of the
13educational services of the district and (ii) is not associated
14with the students' regular class-for-credit schedule or
15required 5 clock hours of instruction shall transport the
16students only in a school bus, a vehicle manufactured to
17transport not more than 10 persons, including the driver, or a
18multifunction school-activity bus manufactured to transport
19not more than 15 persons, including the driver.
20    (a-5) A student in any of grades 9 through 12 may be
21transported in a multi-function school activity bus (MFSAB) as
22defined in Section 1-148.3a-5 of the Illinois Vehicle Code for
23any curriculum-related activity except for transportation on

1regular bus routes from home to school or from school to home,
2subject to the following conditions:
3        (i) A MFSAB may not be used to transport students under
4    this Section unless the driver holds a valid school bus
5    driver permit.
6        (ii) The use of a MFSAB under this Section is subject
7    to the requirements of Sections 6-106.11, 6-106.12,
8    12-707.01, 13-101, and 13-109 of the Illinois Vehicle Code.
9    (b) Any school district furnishing transportation for
10students under the authority of this Section shall insure
11against any loss or liability of the district resulting from
12the maintenance, operation, or use of the vehicle.
13    (c) Vehicles used to transport students under this Section
14may claim a depreciation allowance of 20% over 5 years as
15provided in Section 29-5 of this Code.

17    Section 10. The Illinois Vehicle Code is amended by
18changing Section 11-1414.1 as follows:
 
19    (625 ILCS 5/11-1414.1)  (from Ch. 95 1/2, par. 11-1414.1)
20    Sec. 11-1414.1. School transportation of students.
21    (a) Every student enrolled in grade 12 or below in any
22entity listed in subsection (a) of Section 1-182 of this Code
23must be transported in a school bus or a vehicle described in
24subdivision (1) or (2) of subsection (b) of Section 1-182 of

1this Code for any curriculum-related school activity, except a
2student in any of grades 9 through 12 may be transported in a
3multi-function school activity bus (MFSAB) as defined in
4Section 1-148.3a-5 of this Code for any curriculum-related
5activity except for transportation on regular bus routes from
6home to school or from school to home, subject to the following
7conditions:
8        (i) A MFSAB may not be used to transport students under
9    this Section unless the driver holds a valid school bus
10    driver permit.
11        (ii) The use of a MFSAB under this Section is subject
12    to the requirements of Sections 6-106.11, 6-106.12,
13    12-707.01, 13-101, and 13-109 of this Code.
14    "Curriculum-related school activity" as used in this
15subsection (a) includes transportation from home to school or
16from school to home, tripper or shuttle service between school
17attendance centers, transportation to a vocational or career
18center or other trade-skill development site or a regional safe
19school or other school-sponsored alternative learning program,
20or a trip that is directly related to the regular curriculum of
21a student for which he or she earns credit.
22    (b) Every student enrolled in grade 12 or below in any
23entity listed in subsection (a) of Section 1-182 of this Code
24who is transported in a vehicle that is being operated by or
25for a public or private primary or secondary school, including
26any primary or secondary school operated by a religious

1institution, for an interscholastic, interscholastic-athletic,
2or school-sponsored, noncurriculum-related activity that (i)
3does not require student participation as part of the
4educational services of the entity and (ii) is not associated
5with the students' regular class-for-credit schedule shall
6transport students only in a school bus or vehicle described in
7subsection (b) of Section 1-182 of this Code. This subsection
8(b) does not apply to any second division vehicle used by an
9entity listed in subsection (a) of Section 1-182 of this Code
10for a parade, homecoming, or a similar noncurriculum-related
11school activity.

13    Section 99. Effective date. This Act takes effect upon
14becoming law.
