SYNOPSIS AS INTRODUCED:

Amends the Illinois Municipal Code. Provides that municipalities may license, tax, locate, regulate, or prohibit all places of business of dealers in second-hand articles, including but without limitation, pawnbrokers and dealers in junk, dismantled or wrecked motor vehicles, precious or other metals, rags, or any other second-hand article. Further provides that a municipality may license, tax, regulate, or prohibit hawkers, peddlers, itinerant merchants, and transient vendors of merchandise. Makes other changes. Effective immediately.

AN ACT concerning local government.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Illinois Municipal Code is amended by changing Sections 11-42-3 and 11-42-5 as follows:

Sec. 11-42-3. Regulation of second-hand dealers and certain vendors.

(a) The corporate authorities of each municipality may license, tax, locate, and regulate, or prohibit all places of business of dealers in second-hand articles, including, without limitation, pawnbrokers and dealers in junk, dismantled or wrecked motor vehicles or parts thereof, precious or other metals, rags, or and any second-hand article whatsoever.

(b) The corporate authorities of each municipality may license, tax, regulate, or prohibit hawkers, peddlers, itinerant merchants, and transient vendors of merchandise.

The corporate authorities also may forbid any person from purchasing or receiving from minors without the written consent of their parents or guardians, any article whatsoever.

Sec. 11-42-5. Regulation of amusements. The corporate authorities of each municipality may license, tax, regulate, or prohibit hawkers, peddlers, pawnbrokers, itinerant merchants, transient vendors of merchandise, theatricals and other exhibitions, shows, and amusements and may license, tax, and regulate all places for eating or amusement.

Section 99. Effective date. This Act takes effect upon becoming law.
