SYNOPSIS AS INTRODUCED:
 
65 ILCS 5/11-42-3  from Ch. 24, par. 11-42-3
65 ILCS 5/11-42-5  from Ch. 24, par. 11-42-5

    Amends the Illinois Municipal Code. Provides that municipalities may license, tax, locate, regulate, or prohibit all places of business of dealers in second-hand articles, including but without limitation, pawnbrokers and dealers in junk, dismantled or wrecked motor vehicles, precious or other metals, rags, or any other second-hand article. Further provides that a municipality may license, tax, regulate, or prohibit hawkers, peddlers, itinerant merchants, and transient vendors of merchandise. Makes other changes. Effective immediately.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Municipal Code is amended by
5changing Sections 11-42-3 and 11-42-5 as follows:
 
6    (65 ILCS 5/11-42-3)  (from Ch. 24, par. 11-42-3)
7    Sec. 11-42-3. Regulation of second-hand dealers and
8certain vendors.
9    (a) The corporate authorities of each municipality may
10license, tax, locate, and regulate, or prohibit all places of
11business of dealers in second-hand articles, including,
12without limitation, pawnbrokers and dealers in junk,
13dismantled or wrecked motor vehicles or parts thereof, precious
14or other metals, rags, or and any second-hand article
15whatsoever.
16    (b) The corporate authorities of each municipality may
17license, tax, regulate, or prohibit hawkers, peddlers,
18itinerant merchants, and transient vendors of merchandise.
19    The corporate authorities also may forbid any person from
20purchasing or receiving from minors without the written consent
21of their parents or guardians, any article whatsoever.

2    Sec. 11-42-5. Regulation of amusements. The corporate
3authorities of each municipality may license, tax, regulate, or
4prohibit hawkers, peddlers, pawnbrokers, itinerant merchants,
5transient vendors of merchandise, theatricals and other
6exhibitions, shows, and amusements and may license, tax, and
7regulate all places for eating or amusement.

9    Section 99. Effective date. This Act takes effect upon
10becoming law.
