1    AN ACT concerning safety.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 10. The Illinois Premise Alert Program (PAP) Act is
5amended by changing Sections 10 and 15 as follows:
 
6    (430 ILCS 132/10)
7    Sec. 10. Definitions. As used in this Act:
8    "Disability" means an individual's physical or mental
9impairment that substantially limits one or more of the major
10life activities; a record of such impairment; or when the
11individual is regarded as having such an impairment.
12"Disability" includes, but is not limited to, a medical
13impairment that requires the use of pressurized oxygen.
14    "Special needs individuals" means those individuals who
15have or are at increased risk for a chronic physical,
16developmental, behavioral, or emotional condition and who also
17require health and related services of a type or amount beyond
18that required by individuals generally. "Special needs
19individual" includes, but is not limited to, an individual with
20a medical impairment that requires the use of pressurized
21oxygen.
22    "Public safety agency" means a functional division of a
23public agency that provides firefighting, police, medical, or

1other emergency services.
2    "Computer aided dispatch" or "CAD" means a database
3maintained by the public safety agency or public safety
4answering point used in conjunction with 9-1-1 caller data.
5    "Premise Alert Program" or "PAP" means a computer aided
6dispatch database of individuals with special needs maintained
7by public safety agencies.

10    Sec. 15. Reporting of Special Needs Individuals.
11    (a) Public safety agencies and suppliers of oxygen
12containers used for medical purposes shall make reasonable
13efforts to publicize the Premise Alert Program (PAP) database.
14Means of publicizing the database include, but are not limited
15to, pamphlets and websites.
16    (b) Families, caregivers, or the individuals with
17disabilities or special needs may contact their local law
18enforcement agency or fire department or fire protection
19district.
20    (c) Public safety workers are to be cognizant cognitive of
21special needs individuals they may come across when they
22respond to calls. If workers are able to identify individuals
23who have special needs, they shall try to ascertain as
24specifically as possible what that special need might be. The
25public safety worker should attempt to verify the special need

1as provided in item (2) of subsection (d).
2    (d) The disabled individual's name, date of birth, phone
3number, and residential address or place of employment, and a
4description of whether oxygen canisters are kept at that
5location for medical purposes should also be obtained for
6possible entry into the PAP database.
7        (1) Whenever possible, it is preferable that written
8    permission is obtained from a parent, guardian, family
9    member, or caregiver of the individual themselves prior to
10    being entered into the PAP database.
11        (2) No individual may be entered into a PAP database
12    unless the special need has been verified. Acceptable means
13    of verifying a special need for purposes of this program
14    shall include statements by:
15            (A) the individual,
16            (B) family members,
17            (C) friends,
18            (D) caregivers, or
19            (E) medical personnel familiar with the
20        individual.
21    (e) For public safety agencies that share the same CAD
22database, information collected by one agency serviced by the
23CAD database is to be disseminated to all agencies utilizing
24that database.
25    (f) Information received at an incorrect public safety
26agency shall be accepted and forwarded to the correct agency as

1soon as possible.
2    (g) All information entered into the PAP database must be
3updated every 2 years or when such information changes.

5    Section 99. Effective date. This Act takes effect upon
6becoming law.
