SYNOPSIS AS INTRODUCED:

    Amends the Animal Control Act. Provides that, subject to appropriation, the Department of Agriculture must establish and maintain a dangerous and vicious dog registry. Requires owners of dogs that have been deemed dangerous or vicious to register those animals with their county animal control. Requires county animal control to forward registration information to the Department for posting on the dangerous and vicious dog registry. Requires owners of dangerous and vicious dogs to submit renewal applications each year and to update their registration information when necessary. Establishes registration and renewal fees, which must be deposited into the Dangerous and Vicious Dog Registry Fund for use by the Department to establish the registry. Amends the State Finance Act to create the Dangerous and Vicious Dog Registry Fund. Effective immediately.

1    AN ACT concerning animals.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The State Finance Act is amended by adding
5Section 5.811 as follows:
 
6    (30 ILCS 105/5.811 new)
7    Sec. 5.811. The Dangerous and Vicious Dog Registry Fund.
 
8    Section 10. The Animal Control Act is amended by adding
9Section 15.5 as follows:
 
10    (510 ILCS 5/15.5 new)
11    Sec. 15.5. Dangerous and vicious dog registry.
12    (a) Subject to appropriation, the Department of
13Agriculture shall establish and maintain a dangerous and
14vicious dog registry.
15    (b) Each owner of a dog that has been deemed dangerous or
16vicious shall be required to register the animal as a dangerous
17or vicious dog with their county animal control within 14 days
18after that finding.
19    Each animal control facility in the State shall report each
20declared dangerous or vicious dog within its jurisdiction to
21the Department within 30 days after the dog was declared

1dangerous or vicious.
2    (c) The Department shall receive, post, and maintain the
3information provided by county animal control on a website.
4    All information collected for the registry shall be
5available to animal control officials via the website.
6    (d) Registration shall include the name of the animal, a
7photograph, sex, age, weight, primary breed, secondary breed,
8color and markings, whether spayed or neutered, the acts that
9resulted in the dog being designated as dangerous or vicious
10and associated trial docket information, microchip or tattoo
11number, address where the animal is maintained, name of the
12owner, address of the owner, telephone numbers of the owner,
13and a statement that the owner has complied with the provisions
14of the dangerous or vicious dog order.
15    The address of the owner along with the name and breed of
16the dangerous or vicious dog, the acts that resulted in the dog
17being declared dangerous or vicious, a picture of the dog, and
18information necessary to access court records of the
19adjudication shall be available to the general public.
20    (e) By January 31 of each year, until such time as the
21dangerous or vicious dog is deceased, the owner shall submit a
22renewal registration to the county animal control where he or
23she resides that shall include all information contained in the
24original registration and any updates.
25    In the event that the dangerous or vicious dog is moved to
26a different location, or contact information for the owner

1changes in any way or at any time, the owner shall submit a
2renewal containing the address of the new location or other
3updated information within 10 days after such a move or change.
4There shall be no charge for any updated information provided
5between renewals.
6    The owner shall notify both the Administrator of the county
7animal control where he or she relocated and the Administrator
8of the county animal control where he or she formerly resided.
9    Whenever the owner of a dangerous or vicious dog relocates
10to another state, he or she shall notify (i) the Administrator
11or other comparable authority in the jurisdiction where he or
12she relocates and (ii) the Administrator of the county animal
13control where he or she formerly resided.
14    Each county animal control shall report relocation of each
15declared dangerous or vicious dog within its jurisdiction
16within 30 days after the dog is relocated.
17    (f) The owner shall pay a $100 initial registration fee and
18a $35 annual renewal registration fee to the county animal
19control in the county where the animal resides.
20    (g) The county animal control shall remit registration fees
21to the Department of Agriculture on a quarterly basis, to be
22deposited into the Dangerous and Vicious Dog Registry Fund.
23    (h) The Dangerous and Vicious Dog Registry Fund is hereby
24created as a special fund in the State Treasury to accept fees
25from dangerous and vicious dog registrations, appropriations,
26grants, and donations for the Department of Agriculture to use

1for implementation and maintenance of the Dangerous and Vicious
2Dog Registry.
3    (i) The Department of Agriculture shall adopt rules to
4implement this Section.
 
5    Section 99. Effective date. This Act takes effect upon
6becoming law.
