SYNOPSIS AS INTRODUCED:

225 ILCS 317/48 new

Amends the Fire Sprinkler Contractor Licensing Act. Provides that a municipality, county, or township may not mandate that a fire sprinkler systems is installed in any newly constructed single-family residence. Provides that a municipality, county, or township shall mandate that a residential home builder must offer to each of the residential home builder's clients the option to install a fire sprinkler system in the newly constructed single-family residence. Pre-empts home rule.

AN ACT concerning regulation.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Fire Sprinkler Contractor Licensing Act is amended by adding Section 48 as follows:

Sec. 48. Fire sprinkler installation; residential homes. A municipality, county, or township may not mandate that a fire sprinkler systems is installed in any newly constructed single-family residence.

A municipality, county, or township shall mandate that a residential home builder must offer to each of the residential home builder's clients the option to install a fire sprinkler system in the newly constructed single-family residence.

A home rule unit may not regulate the installation of fire sprinkler systems in a newly constructed single-family residence in a manner inconsistent with this Section. This Section is a limitation under subsection (i) of Section 6 of Article VII of the Illinois Constitution on the concurrent exercise by home rule units of powers and functions exercised by the State.
