SYNOPSIS AS INTRODUCED:
 
225 ILCS 317/48 new

    Amends the Fire Sprinkler Contractor Licensing Act. Provides that a municipality, county, or township may not mandate that a fire sprinkler systems is installed in any newly constructed single-family residence. Provides that a municipality, county, or township shall mandate that a residential home builder must offer to each of the residential home builder's clients the option to install a fire sprinkler system in the newly constructed single-family residence. Pre-empts home rule.

1    AN ACT concerning regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Fire Sprinkler Contractor Licensing Act is
5amended by adding Section 48 as follows:
 
6    (225 ILCS 317/48 new)
7    Sec. 48. Fire sprinkler installation; residential homes. A
8municipality, county, or township may not mandate that a fire
9sprinkler systems is installed in any newly constructed
10single-family residence.
11    A municipality, county, or township shall mandate that a
12residential home builder must offer to each of the residential
13home builder's clients the option to install a fire sprinkler
14system in the newly constructed single-family residence.
15    A home rule unit may not regulate the installation of fire
16sprinkler systems in a newly constructed single-family
17residence in a manner inconsistent with this Section. This
18Section is a limitation under subsection (i) of Section 6 of
19Article VII of the Illinois Constitution on the concurrent
20exercise by home rule units of powers and functions exercised
21by the State.
