SYNOPSIS AS INTRODUCED:
 
20 ILCS 2705/2705-355 new

    Amends the Department of Transportation Law of the Civil Administrative Code of Illinois. Authorizes the Department to enter into contracts to provide feeder services to and from rail terminals and intercity bus transportation. Defines terms. Provides that the Department may provide funding to Amtrak to enter into contracts with motor carriers for intercity transportation if certain conditions are met. Specifies that the first inter-city bus routes the Department coordinates shall be Quincy-Springfield-Decatur-Champaign-Danville and Quad Cities-Galesburg-Peoria-Normal-Champaign-Danville. Effective immediately.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Department of Transportation Law of the
5Civil Administrative Code of Illinois is amended by adding
6Section 2705-355 as follows:
 
7    (20 ILCS 2705/2705-355 new)
8    Sec. 2705-355. Inter-modal transportation.
9    (a) The Department may enter into contracts with any common
10carrier or with any corporation, partnership, or person to
11provide feeder services to and from rail passenger terminals or
12intercity bus transportation.
13    (b) For purposes of this Section:
14    "Amtrak" means the National Railroad Passenger Corporation
15or its successor agency.
16    "Common carrier" means any public or private provider of
17transportation, whether by land, air, or water.
18    "Farebox recovery ratio" means the percentage ratio
19between the cost of providing intercity bus service as the
20denominator and the revenues collected by the sale of bus and
21rail tickets to passengers of mixed-mode feeder bus service as
22the numerator.
23    "Motor carrier of passengers" means a person or entity

1providing motor vehicle transportation of passengers for
2compensation.
3    "Mixed-mode feeder bus service" means bus service carrying
4both passengers connecting to or from a rail service and
5passengers only using the bus service.
6    (c) To the extent permitted by federal law, the Department
7shall encourage Amtrak and motor carriers of passengers to do
8the following:
9        (1) combine or package their respective services and
10    facilities to the public as a means of improving services
11    to the public; and
12        (2) coordinate schedules, routes, rates, reservations,
13        and ticketing to provide for enhanced inter-modal
14        surface transportation.
15    (d) The Department may provide funding to Amtrak for the
16purpose of entering into a contract with a motor carrier of
17passengers for the intercity transportation of passengers by
18motor carrier over regular routes only if all of the following
19conditions are met:
20        (1) Service is provided only on schedules and routes
21    that are coordinated with scheduled intercity rail service
22    to facilitate mixed-mode feeder bus service.
23        (2) The motor carrier is registered with the United
24    States Department of Transportation, operates in
25    compliance with the federal motor carrier safety
26    regulations, and provides service that is accessible to

1    persons with disabilities in compliance with applicable
2    federal regulations pertaining to Amtrak services, in
3    accordance with the federal Americans with Disabilities
4    Act of 1990.
5        (3) The bus service provider and Amtrak issue joint
6    tickets and publish each other's Illinois schedules on
7    their respective websites and timetables and otherwise
8    integrate their operations and schedules to provide a
9    seamless transfer between modes for passengers.
10        (4) All buses operating under the contract display
11    signs on the vehicle that say "Amtrak Illinois" to
12    coordinate with the appearance of State-supported Amtrak
13    service.
14    (e) The Department shall incorporate the conditions
15specified in subsection (d) into State-supported passenger
16rail feeder bus service agreements between Amtrak and motor
17carriers of passengers. The bus service agreements shall also
18provide that a breach of those conditions shall be grounds for
19termination of the agreements.
20    (f) The farebox recovery ratio for State-supported
21mixed-mode feeder bus service must be 100% in Fiscal Year 2012
22and thereafter.
23    (g) The first inter-city bus routes that the Department
24coordinates shall be
25Quincy-Springfield-Decatur-Champaign-Danville and Quad
26Cities-Galesburg-Peoria-Normal-Champaign-Danville.

1Intermediate stops are permitted on these routes. These routes
2shall use the Amtrak facilities in Champaign, Bloomington, and
3Springfield as their terminals.
 
4    Section 99. Effective date. This Act takes effect upon
5becoming law.
