SYNOPSIS AS INTRODUCED:
 
55 ILCS 5/3-3034  from Ch. 34, par. 3-3034

    Amends the Counties Code. Requires that in the event that no family can reasonably be found, a coroner must wait at least 60 days before causing a body or remains to be buried, cremated, or donated for medical science purposes. Effective immediately.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Counties Code is amended by changing Section
53-3034 as follows:
 
6    (55 ILCS 5/3-3034)  (from Ch. 34, par. 3-3034)
7    Sec. 3-3034. Disposition of body. After the inquest the
8coroner may deliver the body or human remains of the deceased
9to the family of the deceased or, if there are no family
10members to accept the body or the remains, then to friends of
11the deceased, if there be any, but if not, the coroner shall
12cause the body or the remains to be decently buried, cremated,
13or donated for medical science purposes, the expenses to be
14paid from the property of the deceased, if there is sufficient,
15if not, by the county. The coroner shall not cause a body or
16remains to be buried, cremated, or donated for medical science
17purposes until at least 60 days after a reasonable attempt has
18been made to locate the family of the deceased. The coroner may
19not approve the cremation or donation of the body if it is
20necessary to preserve the body for law enforcement purposes. If
21the State Treasurer, pursuant to the Uniform Disposition of
22Unclaimed Property Act, delivers human remains to the coroner,
23the coroner shall cause the human remains to be disposed of as
