SYNOPSIS AS INTRODUCED:

    Amends the Guardianship and Advocacy Act. Provides that a simple majority of the members serving on the Guardianship and Advocacy Commission shall constitute a quorum (now, 6 members constitute a quorum). Adds that a member of the Commission shall serve for a term ending on June 30 and until his or her successor is appointed and has qualified or until the member resigns and the resignation is filed with the Secretary of State. Provides that a simple majority of the members serving on a regional human rights authority shall constitute a quorum (now, 5 members constitute a quorum). Effective immediately.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Guardianship and Advocacy Act is amended by
5changing Sections 4 and 14 as follows:
 
6    (20 ILCS 3955/4)  (from Ch. 91 1/2, par. 704)
7    Sec. 4. Commission; membership; term of office.
8    (a) The Commission shall consist of 11 members, one of whom
9shall be a senior citizen age 60 or over, who shall be
10appointed by the Governor, taking into account the requirements
11of State and federal statutes, with the advice and consent of
12the Senate.
13    All appointments shall be filed with the Secretary of State
14by the appointing authority.
15    (b) The terms of the original members shall be 3 one year
16terms, 3 two year terms, and 3 three year terms, all terms to
17continue until a successor is appointed and qualified. The
18length of the terms of the original members shall be drawn by
19lot of the first meeting held by the Commission. The members
20first appointed under this amendatory Act of 1984 shall serve
21for a term of 3 years. Thereafter all terms shall be for 3
22years, with each member serving no more than 2 consecutive
23terms. Vacancies in the membership are to be filled in the same

1manner as original appointments. Appointments to fill
2vacancies occurring before the expiration of a term are for the
3remainder of the unexpired term. A member of the Commission
4shall serve for a term ending on June 30 and until his or her
5successor is appointed and has qualified or until the member
6resigns and the resignation is filed with the Secretary of
7State.
8    (c) The Commission shall annually elect a Chairman and any
9other officers it deems necessary. The Commission shall meet at
10least once every 3 months with the times and places of meetings
11determined by the Chairman. Additional meetings may be called
12by the Chairman upon written notice 7 days before the meeting
13or by written petition of 5 members to the Chairman. A simple
14majority of the members serving on Six members of the
15Commission shall constitute a quorum.
16    (d) Members of the Commission are not entitled to
17compensation but shall receive reimbursement for actual
18expenses incurred in the performance of their duties.

21    Sec. 14. Regional authorities; membership; term of office.
22Each regional authority shall consist of the 9 members
23appointed by the Director, in accordance with this Section.
24Each regional authority shall include insofar as possible one
25professionally knowledgeable and broadly experienced employee

1or officer of a provider of each of the following services:
2mental health, developmental disabilities, and vocational
3rehabilitation. No other employee or officer of a service
4provider shall be appointed to a regional authority. In making
5appointments, the Director shall strive to ensure
6representation of minority groups and of eligible persons, and
7shall give due consideration to recommendations of persons and
8groups assisting eligible persons. The Director may remove for
9incompetence, neglect of duty, or malfeasance in office any
10member of a regional authority. All actions taken by the
11Director to appoint or remove members shall be reported to the
12Commission at the next scheduled Commission meeting.
13    Each regional authority shall annually elect a chairman and
14any other officers it deems necessary. Members of the regional
15authorities shall serve for a term of 3 years, except that the
16terms of the first appointees shall be as follows: 3 members
17serving for a 1 year term; 3 members serving for a 2 year term;
18and 3 members serving for a 3 year term. Assignment of terms of
19such first appointees shall be by lot. No member shall serve
20for more than 2 consecutive 3 year terms. A simple majority of
21the members serving on a regional authority Five members shall
22constitute a quorum.
23    Vacancies in the regional authorities shall be filled in
24the same manner as original appointments.
25    Members of the regional authorities shall serve without
26compensation but shall be reimbursed for actual expenses

1incurred in the performance of their duties.
2    Each regional authority shall meet not less than once every
32 months. Meetings may also be held upon call of the Regional
4Chairman or upon written request of a simple majority of the
5members serving on any 5 members of the regional authority.

7    Section 99. Effective date. This Act takes effect upon
8becoming law.
