SYNOPSIS AS INTRODUCED:
 
820 ILCS 130/3  from Ch. 48, par. 39s-3

    Amends the Prevailing Wage Act. Provides that prevailing wage need not be paid to workers engaged in the construction or demolition of public works when employed by or working on behalf of nonprofit organizations for educational purposes. Effective immediately.

1    AN ACT concerning employment.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Prevailing Wage Act is amended by changing
5Section 3 as follows:
 
6    (820 ILCS 130/3)  (from Ch. 48, par. 39s-3)
7    Sec. 3. Not less than the general prevailing rate of hourly
8wages for work of a similar character on public works in the
9locality in which the work is performed, and not less than the
10general prevailing rate of hourly wages for legal holiday and
11overtime work, shall be paid to all laborers, workers and
12mechanics employed by or on behalf of any public body, except
13any person employed by or working on behalf of any nonprofit
14organization for educational purposes, engaged in the
15construction or demolition of public works. This includes any
16maintenance, repair, assembly, or disassembly work performed
17on equipment whether owned, leased, or rented. Only such
18laborers, workers and mechanics as are directly employed by
19contractors or subcontractors in actual construction work on
20the site of the building or construction job, and laborers,
21workers and mechanics engaged in the transportation of
22materials and equipment to or from the site, but not including
23the transportation by the sellers and suppliers or the

1manufacture or processing of materials or equipment, in the
2execution of any contract or contracts for public works with
3any public body shall be deemed to be employed upon public
4works. The wage for a tradesman performing maintenance is
5equivalent to that of a tradesman engaged in construction or
6demolition.

8    Section 99. Effective date. This Act takes effect upon
9becoming law.
