1     AN ACT concerning transportation.

2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:

4     Section 5. The Illinois Highway Code is amended by changing
5 Section 9-113.02 as follows:

6     (605 ILCS 5/9-113.02)
7     Sec. 9-113.02. Damage to State-owned or local
8 government-owned roadway property. Any agency or
9 instrumentality of the State of Illinois or unit of local
10 government may seek recovery for the cost of the repair or
11 replacement of damaged or destroyed roadway property. As used
12 in this Section, "roadway property" includes road safety
13 equipment and emergency equipment. Depreciation may not be used
14 as a factor in determining the cost of the damaged or destroyed
15 roadway property for which recovery is sought.
