SYNOPSIS AS INTRODUCED:

725 ILCS 5/Art. 106F heading new
725 ILCS 5/106F-5 new

Amends the Code of Criminal Procedure of 1963 if and only if Senate Bill 3539 of the 96th General Assembly becomes law. Provides that the following question of public policy shall be submitted to the electors of the State at the 2012 general election: "Should the General Assembly of the State of Illinois enact a law providing for capital punishment for first degree murder and establishing procedures for the imposition of capital punishment that are consistent with the United States Constitution as interpreted by the United States Supreme Court?". Contains an internal repealer. Effective immediately or on the effective date of Senate Bill 3539 of the 96th General Assembly, whichever is later.

A BILL FOR

AN ACT concerning criminal law.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. If and only if Senate Bill 3539 of the 96th General Assembly becomes law, then the Code of Criminal Procedure of 1963 is amended by adding Article 106F as follows:

ARTICLE 106F. QUESTION OF PUBLIC POLICY; CAPITAL PUNISHMENT

Sec. 106F-5. Question of public policy; capital punishment.

(a) The State Board of Elections shall certify the question to the proper election officials who shall submit the question at the general election in 2012 in accordance with the general election law:

"Should the General Assembly of the State of Illinois enact a law providing for capital punishment for first degree murder and establishing procedures for the imposition of capital punishment that are consistent with the United States Constitution as interpreted by the United States Supreme Court?"

The votes shall be recorded as "Yes" or "No".

(b) This Article 106F is repealed on January 1, 2013.

Section 99. Effective date. This Act takes effect upon becoming law or on the effective date of Senate Bill 3539 of the 96th General Assembly, whichever is later.
