SYNOPSIS AS INTRODUCED:
 
20 ILCS 3960/12.4

    Amends the Illinois Health Facilities Planning Act in the provision concerning written notice of a hospital's reduction in health care services. Provides that the notice must be given if a hospital reduces certain services by 25% (instead of 50%). Provides that the notice shall include a report setting forth the reasons for the reduction in service and any foreseeable impact to other hospitals in the region. Provides that the report shall be made available to the public and shall be published on the hospital's website. Makes other changes. Effective immediately.

1    AN ACT concerning health.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Health Facilities Planning Act is
5amended by changing Section 12.4 as follows:
 
6    (20 ILCS 3960/12.4)
7    (Section scheduled to be repealed on December 31, 2019)
8    Sec. 12.4. Hospital reduction in health care services;
9notice. If a hospital reduces any of the Categories of Service
10as outlined in Title 77, Chapter II, Part 1110 in the Illinois
11Administrative Code, any service outlined in the Hospital
12Emergency Service Act, or any other service as defined by rule
13by the State Board, by 25% 50% or more according to rules
14adopted by the State Board, then within 30 days prior to after
15reducing the service, the hospital must give written notice of
16the reduction in service to the State Board, the Department of
17Public Health, and the State Senator and 2 State
18Representatives serving the legislative district in which the
19hospital is located. The written notice shall include a report
20setting forth the reasons for the reduction in service and any
21foreseeable impact to other hospitals in the region. The report
22shall be made available to the public and shall be published on
23the hospital's website. The State Board shall adopt rules to

1implement this Section, including rules that specify (i) how
2each health care service is defined, if not already defined in
3the State Board's rules, and (ii) what constitutes a reduction
4in service of 50% or more.
