SYNOPSIS AS INTRODUCED:

605 ILCS 10/32.1 new

Amends the Toll Highway Act. Provides that the Toll Highway Authority may exercise any powers it has under the Toll Highway Act on the effective date of this amendatory Act to construct new railroad tracks. Provides that the Authority may charge an access fee to any passenger or freight rail operator who wishes to use tracks which the Authority has constructed using powers granted under this amendatory Act. Effective immediately.

A BILL FOR

AN ACT concerning transportation.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Toll Highway Act is amended by adding Section 32.1 as follows:

(605 ILCS 10/32.1 new)

Sec. 32.1. Power to construct railroad tracks. The Authority may exercise any powers that exist under this Act on the effective date of this amendatory Act of the 97th General Assembly to construct new railroad tracks. The Authority may charge an access fee to any passenger or freight rail operator who wishes to use tracks which the Authority has constructed using the powers granted by this Section.

Section 99. Effective date. This Act takes effect upon becoming law.
