SYNOPSIS AS INTRODUCED:

625 ILCS 5/3-600.1 new

Amends the Illinois Vehicle Code. Provides that, beginning with the 2013 registration year, the Secretary of State may reissue only those non-military and non-veteran special plates that belong to any plate category for which the Secretary has received at least 3,000 applications as of the effective date of the amendatory Act. Provides that persons who have been issued special plates that are discontinued under the new provision may continue to display those special plates, and the Secretary shall continue to accept annual fees for renewal stickers for those plates from those persons. Provides that the Secretary shall no longer issue any new category of special plates. Provides that persons and organizations seeking issuance of special plates, and persons holding discontinued plates who need to replace them, may apply for Universal Charitable Organization license plates and decals under the Code.

AN ACT concerning transportation.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Illinois Vehicle Code is amended by changing Section 3-600 and adding Section 3-600.1 as follows:

Sec. 3-600. Requirements for issuance of special plates.

(a) The Secretary of State shall issue only special plates that have been authorized by the General Assembly. The Secretary of State shall not issue a series of special plates unless applications, as prescribed by the Secretary, have been received for 10,000 plates of that series; except that the Secretary of State may prescribe some other required number of applications if that number is sufficient to pay for the total cost of designing, manufacturing and issuing the special license plate.

(b) The Secretary of State, upon issuing a new series of special license plates, shall notify all law enforcement officials of the design, color and other special features of the special license plate series.

(c) This Section shall not apply to special license plate categories in existence on the effective date of this amendatory Act of 1990, or to the Secretary of State's discretion as established in Section 3-611.

(d) Beginning with the 2013 registration year, the provisions of Section 3-600.1 control the issuance and re-issuance of special plates.

Sec. 3-600.1. Special plates; minimum number of applications required for continued issuance.

(a) Beginning with the 2013 registration year, the Secretary of State may reissue only those non-military and non-veteran special plates that belong to any plate category for which the Secretary has received at least 3,000 applications as of the effective date of this amendatory Act of the 97th General Assembly.

(b) Persons who have been issued special plates that are discontinued under subsection (a) may continue to display those special plates, and the Secretary shall continue to accept annual fees for renewal stickers for those plates from those persons.

(c) Beginning with the 2013 registration year, the Secretary may not issue any new category of special plates.

(d) Persons and organizations seeking issuance of special plates may apply for Universal Charitable Organization license plates under Section 3-633 of this Code, with charitable decals approved under that Section. When special plates of a discontinued plate category must be replaced, the Secretary shall issue Universal Charitable Organization plates and decals under Section 3-633 to replace them, upon receipt of all applicable fees and applications.
