SYNOPSIS AS INTRODUCED:
 
305 ILCS 5/5-2.3

    Amends the Illinois Public Aid Code. In regards to medical assistance for institutionalized persons, requires the Department of Healthcare and Family Services to notify the applicant or recipient, or the spouse of the applicant or recipient, or a person for whom the applicant or recipient is the primary caretaker, of his or her obligation to make application for benefits within 7 days of the applicant or recipient entering an institution and that this requirement may be satisfied by providing the facility with the necessary documentation required to prove eligibility as part of seeking the institution's assistance in making application.

1     AN ACT concerning public aid.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Public Aid Code is amended by
5 changing Section 5-2.3 as follows:
 
6     (305 ILCS 5/5-2.3)
7     Sec. 5-2.3. Notice of rights concerning
8 institutionalization. The Illinois Department shall prepare a
9 notice to be given to every applicant for and recipient of
10 medical assistance under this Article when the applicant or
11 recipient, or the spouse of the applicant or recipient, or a
12 person for whom the applicant or recipient is the primary
13 caretaker, becomes an institutionalized person. The notice
14 shall fully and completely inform the institutionalized person
15 (and that person's spouse or primary caretaker, if applicable)
16 of each individual's rights and obligations under this Code
17 with respect to that institutionalization. The notice shall
18 inform the applicant or recipient, or the spouse of the
19 applicant or recipient, or a person for whom the applicant or
20 recipient is the primary caretaker, of his or her obligation to
21 make application for benefits within 7 days of the applicant or
22 recipient entering an institution and that this requirement may
23 be satisfied by providing the facility with the necessary
