    Amends the Illinois Vehicle Code to require every operator and passenger on a motorcycle, motor driven cycle, or motorized pedalcycle to wear a helmet that meeter federal safety standards.

1     AN ACT concerning transportation.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Vehicle Code is amended by changing
5 Section 11-1404 as follows:
 
6     (625 ILCS 5/11-1404)  (from Ch. 95 1/2, par. 11-1404)
7     Sec. 11-1404. Special equipment for persons riding
8 motorcycles, motor driven cycles, or motorized pedalcycles.
9     (a) The operator and every passenger of a motorcycle, motor
10 driven cycle, or motorized pedalcycle must wear a helmet, which
11 meets the requirements of Federal Motor Vehicle Safety Standard
12 No. 218, and must and every passenger thereon shall be
13 protected by glasses, goggles, or a transparent shield.
14     (b) For the purposes of this Section, glasses, goggles, and
15 transparent shields are defined as follows:
16     "Glasses" means ordinary eye pieces such as spectacles or
17 sunglasses worn before the eye, made of shatter-resistant
18 material. Shatter-resistant material, as used in this Section,
19 means material so manufactured, fabricated, or created that it
20 substantially prevents shattering or flying when struck or
21 broken.
22     "Goggles" means a device worn before the eyes, the
23 predominant function of which is protecting the eyes without

1 obstructing peripheral vision. Goggles shall provide
2 protection from the front and sides, and may or may not form a
3 complete seal with the face.
4     "Transparent shield" means a windshield attached to the
5 front of a motorcycle that extends above the eyes when an
6 operator is seated in the normal, upright riding position, made
7 of shatter-resistant material, or a shatter-resistant
8 protective face shield that covers the wearer's eyes and face
9 at least to a point approximately to the tip of the nose.
10     (c) Contact lenses are not acceptable eye protection
11 devices.
