1     AN ACT concerning public aid.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Public Aid Code is amended by
5 changing Section 5-5.4a as follows:
 
6     (305 ILCS 5/5-5.4a)
7     Sec. 5-5.4a. Intermediate Care Facility for the
8 Developmentally Disabled; bed reserve payments.
9     The The Department of Public Aid shall promulgate rules by
10 October 1, 1993 which establish a policy of bed reserve
11 payments to Intermediate Care Facilities for the
12 Developmentally Disabled which addresses the needs of
13 residents of Intermediate Care Facilities for the
14 Developmentally Disabled (ICF/DD) and their families.
15     (a) When a resident of an Intermediate Care Facility for
16 the Developmentally Disabled (ICF/DD) is absent from the ICF/DD
17 in which he or she is a resident for purposes of physician
18 authorized in-patient admission to a hospital, the
19 Department's rules shall, at a minimum, provide (1) bed reserve
20 payments at a daily rate which is 100% of the client's current
21 per diem rate, for a period not exceeding 10 consecutive days;
22 (2) bed reserve payments at a daily rate which is 75% of a
23 client's current per diem rate, for a period which exceeds 10

1 consecutive days but does not exceed 30 consecutive days; and
2 (3) bed reserve payments at a daily rate which is 50% of a
3 client's current per diem rate for a period which exceeds
4 thirty consecutive days but does not exceed 45 consecutive
5 days.
6     (b) When a resident of an Intermediate Care Facility for
7 the Developmentally Disabled (ICF/DD) is absent from the ICF/DD
8 in which he or she is a resident for purposes of a home visit
9 with a family member the Department's rules shall, at a
10 minimum, provide (1) bed reserve payments at a rate which is
11 100% of a client's current per diem rate, for a period not
12 exceeding 10 days per State fiscal year; and (2) bed reserve
13 payments at a rate which is 75% of a client's current per diem
14 rate, for a period which exceeds 10 days per State fiscal year
15 but does not exceed 30 days per State fiscal year.
16     (c) No Department rule regarding bed reserve payments shall
17 require an ICF/DD to have a specified percentage of total
18 facility occupancy as a requirement for receiving bed reserve
19 payments.
20     This Section 5-5.4a shall not apply to any State operated
21 facilities.
