1     AN ACT concerning counties.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Counties Code is amended by adding Section
5 5-1035.3 as follows:
 
6     (55 ILCS 5/5-1035.3 new)
7     Sec. 5-1035.3. Tax increase opt out.
8     (a) A county, by ordinance or resolution adopted by the
9 county board or by referendum, may opt out of any tax increase
10 imposed pursuant to Section 4.03 of the Regional Transportation
11 Act, as amended by Public Act 95-708, and to be used by the
12 county as provided in Section 4.03.3 of that Act. If a county
13 opts out of a tax increase, then the tax increase shall no
14 longer be imposed or collected in the county and the county
15 shall no longer receive distributions or any other benefits
16 derived from the imposition of the tax increase.
17     (b) The county board, by resolution, may provide for the
18 submission to the electors the question of whether the county
19 shall opt out of a tax increase. The board shall certify the
20 resolution and proposition to the proper election officials,
21 who shall submit the question to the electors at the
22 consolidated or general election next occurring and in
23 accordance with the general election law. The proposition shall

1 be in substantially the following form:
2         Shall the County of (insert name of county) opt out of
3     (insert description of tax increase)?
4     The votes shall be recorded as "Yes" or "No".
5     If a majority of the electors voting on the proposition
6 vote in favor of it, then the county has opted out of the tax
7 increase.
8     (c) A county may not opt out of any tax increase under this
9 Section if the proceeds are pledged to make principal or
10 interest payments on bonds or other long-term debt.
 
11     Section 99. Effective date. This Act takes effect upon
12 becoming law.
