1     AN ACT concerning animals.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Bovine Brucellosis Eradication Act
5 is amended by changing Sections 1.5 and 5 and by adding Section
6 1.16 as follows:

8     Sec. 1.5. The term "infected animal" or "reactor" means an
9 animal which has given positive reaction to an official test
10 for the detection of brucellosis and has been so classified
11 after review by the designated brucellosis epidemiologist, or
12 other State and federally approved designee, or if Brucella
13 microorganisms have been found in the body or in the body
14 discharges.

17     Sec. 1.16. Designated brucellosis epidemiologist. The term
18 "designated brucellosis epidemiologist" means an
19 epidemiologist who has demonstrated the knowledge and ability
20 to perform the functions required by the U.S. Department of
21 Agriculture and who has been selected as a designated
22 brucellosis epidemiologist by the State Animal Health Official

1 and the U.S. Department of Agriculture.

3     Sec. 5. When one or more animals in a herd have been
4 classified as reactors to an official test, the entire herd,
5 except steers, spayed heifers and calves under 6 months of age,
6 shall be quarantined immediately and the owner so notified. An
7 accredited veterinarian or a veterinarian in the employ of the
8 Animal and Plant Health Inspection Service of the United States
9 Department of Agriculture, or any successor agency, shall
10 permanently hot iron brand each animal classified as a reactor,
11 within 15 days after classification of such animal as a
12 reactor, on the left hip with the letter "B", such letter to be
13 not less than 2 nor more than 3 inches in height, and shall
14 place a special identification tag in the left ear of such
15 reactor. The veterinarian applying an official test for
16 brucellosis shall immediately notify the Department of each
17 such reactor on forms furnished by the Department, giving the
18 number of the tag placed in the left ear and the number of any
19 tag in the right ear. Reactors shall be shipped for slaughter
20 within 30 days of test date, except that the Department may,
21 upon request, grant an extension of not more than 30 days.
22 Suspect animals which have a history of having aborted and are
23 from a herd containing reactors may be designated as reactors
24 by the veterinarian obtaining the blood samples, when approved
25 by the Department. Suspect animals in herds under quarantine

1 due to brucellosis infection may be designated as reactors by
2 the Department if deemed advisable in the interest of
3 brucellosis eradication. No person shall remove any reactor
4 identification tag.
5     All animals classified as suspects to an official test
6 shall be positively identified and their movement restricted to
7 the premises where found until they are retested and found
8 negative, or identified as reactors.
9     Animals with a positive result to an official test at
10 livestock markets may be slaughtered or returned to the herd of
11 origin only by permit and must remain under quarantine for
12 further evaluation.

14     Section 99. Effective date. This Act takes effect upon
15 becoming law.
