SYNOPSIS AS INTRODUCED:
 
40 ILCS 5/3-136   from Ch. 108 1/2, par. 3-136
40 ILCS 5/4-123.1   from Ch. 108 1/2, par. 4-123.1

    Amends the Downstate Police and Downstate Firefighter Articles of the Illinois Pension Code. Allows the employer municipality to appear at a hearing involving officers or members of the police department and officers or members of the fire department as a matter of right. Effective immediately.

1     AN ACT concerning public employee benefits.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Pension Code is amended by changing
5 Sections 3-136 and 4-123.1 as follows:
 
6     (40 ILCS 5/3-136)  (from Ch. 108 1/2, par. 3-136)
7     Sec. 3-136. Witnesses. To subpoena witnesses.
8     (a) To compel witnesses to attend and testify before it
9 upon all matters connected with the administration of this
10 Article, in the manner provided by law for the taking of
11 testimony in the circuit courts of this State. The president,
12 or any board member, may administer oaths to witnesses.
13     (b) If not otherwise a party to a hearing involving an
14 officer or member of the police department, the employer
15 municipality shall be permitted to appear as a matter of right.
