SYNOPSIS AS INTRODUCED:
 
30 ILCS 605/7.3   from Ch. 127, par. 133b10.3

    Amends the State Property Control Act. Provides that one of the State's airplanes, designated by the Secretary of Transportation, is deemed to be surplus property and shall be sold as soon as possible. Requires that its sale proceeds be deposited equally into the State Parks Fund and the Parks and Conservation Fund. Effective immediately.

1     AN ACT concerning finance.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The State Property Control Act is amended by
5 changing Section 7.3 as follows:
 
6     (30 ILCS 605/7.3)  (from Ch. 127, par. 133b10.3)
7     Sec. 7.3. The Administrator shall have charge of all
8 transferable property and shall have authority to take
9 possession and control of such property in order to transfer or
10 assign any such property to any other State agency that has
11 need or use for such property or to dispose of said property in
12 accordance with Section 7 of this Act.
13     The Administrator may not dispose of a transferable
14 airplane by sale until he or she determines that (i) the agency
15 no longer has a need for the airplane, (ii) the airplane will
16 not be used as a trade-in on another aircraft, and (iii) no
17 public university or college in Illinois that offers courses in
18 aviation, flight training, or other subjects involving
19 knowledge of the workings of an airplane has listed the need
20 for an airplane as provided in this Section, except that of the
21 Beechcraft KA-350 executive aircraft owned by the State on the
22 effective date of this amendatory Act of the 95th General
23 Assembly, one designated by the Secretary of Transportation is

1 deemed surplus property and shall be sold by the Administrator
2 as soon as possible after the effective date of this amendatory
3 Act of the 95th General Assembly. Proceeds from the sale of
4 that Beechcraft KA-350 executive aircraft shall be deposited
5 equally into the State Parks Fund and the Parks and
6 Conservation Fund.
7     Responsible officers shall periodically report all
8 transferable property at locations under their jurisdictions
9 to the Administrator. The Administrator shall review such
10 reports and arrange for physical examination of said property
11 if necessary to determine if said items of transferable
12 property should be transferred to another State agency,
13 transferred to a central warehouse, or disposed of. The
14 Administrator shall advise responsible officers of the results
15 of these reviews as necessary.
16     The staff under the jurisdiction of the Administrator shall
17 review as necessary State agencies' inventories for potential
18 items of transferable property. If in the opinion of the
19 Administrator's staff, any property appears to be
20 transferable, the Administrator shall notify the responsible
21 officer of his determination. The executive head of the agency
22 holding the property in question may appeal the determination
23 in writing to the Administrator.
24     The Administrator will review the determination in
25 accordance with rules and procedures established pursuant to
26 Section 5 of this Act.

1     The Administrator shall maintain lists of transferable
2 property and of State agency needs for such property and will
3 transfer where appropriate listed transferable property to
4 agencies listing their needs for such property as detailed by
5 their responsible officers. The Administrator must give
6 priority for transfer of an airplane, that is not to be used as
7 a trade-in, to a public university or college in Illinois that
8 offers courses in aviation, flight training, or other subjects
9 involving knowledge of the workings of an airplane and that has
10 listed the need for an airplane.

12     Section 99. Effective date. This Act takes effect upon
13 becoming law.
