SYNOPSIS AS INTRODUCED:
 
New Act

    Creates the Job Impact Note Act. Requires that a note be prepared for a bill before second reading in the house of introduction concerning the impact of the bill on employment opportunities in Illinois. Also, requires a note for administrative rules before approval by JCAR. Requires the Commission on Government Forecasting and Accountability to prepare the notes.

1     AN ACT concerning job impact notes.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 1. Short title. This Act may be cited as the Job
5 Impact Note Act.
 
6     Section 5. Applicability.
7     (a) Every bill, except those making a direct appropriation,
8 the purpose or effect of which is to directly increase or
9 decrease employment opportunities in Illinois, shall have
10 prepared for it, before second reading in the house of
11 introduction, a brief explanatory statement or note that shall
12 include a reliable estimate of the anticipated impact.
13     (b) Every proposed rule of an agency, the purpose or effect
14 of which is to directly increase or decrease employment
15 opportunities in Illinois, shall have prepared for it, before
16 approval by the Joint Committee on Administrative Rules
17 pursuant to the Illinois Administrative Procedure Act, a brief
18 explanatory statement or note that shall include a reliable
19 estimate of the anticipated impact. As used in this Act, "rule"
20 and "agency" have the same meanings as in the Illinois
21 Administrative Procedure Act.
22     (c) These statements or notes shall be known as job impact
23 notes.

1     Section 10. Preparation. The sponsor of each bill, or the
2 agency proposing a rule, to which Section 5 applies, shall
3 present a copy of the bill or proposed rule, with the request
4 for a job impact note, to the Commission on Government
5 Forecasting and Accountability (the "Commission"). The job
6 impact note shall be prepared by the Commission and submitted
7 to the sponsor of the bill or the agency within 5 calendar
8 days, except that whenever, because of the complexity of the
9 measure, additional time is required for the preparation of the
10 note, the Commission may inform the sponsor of the bill or the
11 agency, and the sponsor or agency may approve an extension of
12 the time within which the note is to be submitted, not to
13 extend, however, beyond June 15, following the date of the
14 request. If, in the opinion of the Commission, there is
15 insufficient information to prepare a reliable estimate of the
16 anticipated impact, a statement to that effect can be filed and
17 shall meet the requirements of this Act.
 
18     Section 15. Vote on necessity of employment impact notes.
19 Whenever the sponsor of any bill is of the opinion that no job
20 impact note is required, any member of either house may request
21 that a note be obtained, and in that case the applicability of
22 this Act shall be decided by the majority of those present and
23 voting in the house of which the sponsor is a member.

1     Section 20. Requisites and contents. The note shall be
2 factual in nature, as brief and concise as may be, and shall
3 provide a reliable estimate of the employment opportunities
4 that will be created or lost, and, in addition, it shall
5 include both the immediate effect and, if determinable or
6 reasonably foreseeable, the long range effect of the measure.
7 If, after careful investigation, it is determined that no
8 estimate is possible, the note shall contain a statement to
9 that effect, setting forth the reasons why no estimate can be
10 given. A brief summary or work sheet of computations used in
11 arriving at job impact note figures shall be included.
 
12     Section 25. Comment or opinion; technical or mechanical
13 defects. No comment or opinion shall be included in the job
14 impact note with regard to the merits of the measure for which
15 the note is prepared; however, technical or mechanical defects
16 may be noted.
 
17     Section 30. Appearance of State officials and employees in
18 support or opposition of measure. The fact that an job impact
19 note is prepared for any bill or proposed rule shall not
20 preclude or restrict the appearance before any committee of the
21 General Assembly, or before the Joint Committee on
22 Administrative Rules, of any official or authorized employee of
23 the Commission who desires to be heard in support of or in
24 opposition to the measure.

1     Section 35. Amendment of bill necessitating statement of
2 effect of proposed amendment. Whenever any committee of either
3 house reports any bill with an amendment that will
4 substantially affect the figures stated in the job impact note
5 attached to the measure at the time of its referral to the
6 committee, there shall be included with the report of the
7 committee a statement of the effect of the change proposed by
8 the amendment reported if desired by a majority of the
9 committee. Whenever any bill is amended on the floor of either
10 house to substantially affect the figures as stated in the job
11 impact note attached to the bill before the amendment, a
12 majority of the members of that house may propose that no
13 action shall be taken on the amendment until the sponsor of the
14 amendment presents to the members a statement of the employment
15 impact of the proposed amendment.
