SYNOPSIS AS INTRODUCED:
 
New Act

    Creates the Medication Aide Pilot Program Act. Directs the Board of Nursing to establish a pilot program in assisted living establishments to determine the impact on resident health and safety of allowing certified nursing assistants acting as pilot study medication aides to administer medications under educational requirements and conditions prescribed by the Board. Prohibits assisted living establishments participating in the pilot program from replacing existing registered nurse and licensed practical nurse positions with certified nursing assistants or pilot study medication aides. Requires the pilot program to be completed by December 1, 2010, and requires the Board to report the results to the Governor and the General Assembly. Effective immediately.

1     AN ACT concerning health.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 1. Short title. This Act may be cited as the
5 Medication Aide Pilot Program Act.
 
6     Section 5. Definitions. In this Act:
7     "Assisted living establishment" means an assisted living
8 establishment licensed under the Assisted Living and Shared
9 Housing Act.
10     "Board" means the Board of Nursing appointed by the
11 Secretary of Financial and Professional Regulation.
 
12     Section 10. Pilot program. The Board shall establish a
13 pilot program to determine the impact on resident health and
14 safety of allowing certified nursing assistants acting as pilot
15 study medication aides to administer medications under
16 educational requirements and conditions prescribed by the
17 Board. The Board shall conduct the pilot in no more than 10
18 assisted living establishments. The pilot program shall not be
19 conducted in dementia units of assisted living establishments.
 
20     Section 15. Assisted living establishments; conditions of
21 participation. Except as otherwise provided in this Section,

1 assisted living establishments participating in the pilot
2 program shall not replace existing registered nurse and
3 licensed practical nurse positions with certified nursing
4 assistants or pilot study medication aides. The Board may
5 authorize, as part of the pilot program, adjustments to an
6 assisted living establishment's nursing staff mix as necessary
7 to conduct an evidence-based study to determine the impact of
8 varying staffing models upon resident health and safety.
9 Assisted living establishments participating in the pilot
10 program shall not violate State or federal laws relating to the
11 adequacy of nursing coverage.
 
12     Section 20. Program features. The pilot program must
13 include delegation and supervision protocols regarding which
14 medications the pilot study medication aides may and may not
15 administer and under what conditions the medications may be
16 administered. The protocols shall prohibit medication aides
17 from administering any medication or fluid by needle, IV, or
18 feeding tube. The protocols must give registered nurses the
19 authority to refuse to delegate the administration of
20 medications to pilot study medication aides if a nurse believes
21 that resident health and safety is at risk.
 
22     Section 25. Policies of the Board. The Board shall adopt
23 policies prescribing the training program and certification
24 requirements for certified nursing assistants participating in

1 the pilot program as pilot study medication aides based on the
2 model curriculum of the National Council of State Boards of
3 Nursing.
 
4     Section 30. Time period; report.
5     (a) The Board shall complete the pilot program on or before
6 December 1, 2010.
7     (b) The Board shall submit a written report on or before
8 December 1, 2010 to the Governor and the Illinois General
9 Assembly regarding the results of the pilot program and
10 recommendations for any administrative or legislative action.
 
11     Section 99. Effective date. This Act takes effect upon
12 becoming law.
