SYNOPSIS AS INTRODUCED:

105 ILCS 5/10-20.40 new
105 ILCS 5/34-18.34 new
30 ILCS 805/8.31 new

    Amends the School Code. Provides that a school board shall prohibit the use of metal detectors on students in kindergarten through 6th grade. Provides that any school district that uses metal detectors must annually report statistical data related to the use of metal detectors to the State Board of Education. Requires the State Board to annually compile the statistical data in a report to be filed with the General Assembly. Amends the State Mandates Act to require implementation without reimbursement.

1     AN ACT concerning education.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The School Code is amended by adding Sections
5 2-3.142, 10-20.40, and 34-18.34 as follows:
 
6     (105 ILCS 5/2-3.142 new)
7     Sec. 2-3.142. Metal detectors. The State Board of Education
8 may adopt any rules necessary to implement Sections 10-20.40
9 and 34-18.34 of this Code. The State Board shall annually
10 compile the statistical data reported to the State Board by
11 school districts under Sections 10-20.40 and 34-18.34 of this
12 Code in a report to be filed with the General Assembly as
13 provided in Section 3.1 of the General Assembly Organization
14 Act.

18 through 6th grade. Any school district that uses metal
19 detectors must annually report statistical data related to the

1     Sec. 34-18.34. Metal detectors. The board shall prohibit
2 the use of metal detectors on students in kindergarten through
3 6th grade. If the school district uses metal detectors, the
4 district must annually report statistical data related to the
5 use of metal detectors to the State Board of Education.
 
6     Section 90. The State Mandates Act is amended by adding
7 Section 8.31 as follows:
 
8     (30 ILCS 805/8.31 new)
9     Sec. 8.31. Exempt mandate. Notwithstanding Sections 6 and 8
10 of this Act, no reimbursement by the State is required for the
11 implementation of any mandate created by this amendatory Act of
12 the 95th General Assembly.
