1     AN ACT concerning conservation.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Open Space Lands Acquisition and Development
5 Act is amended by changing Section 3 as follows:
 
6     (525 ILCS 35/3)  (from Ch. 85, par. 2103)
7     Sec. 3. From appropriations made from the Capital
8 Development Fund, Build Illinois Bond Fund or other available
9 or designated funds for such purposes, the Department shall
10 make grants to local governments as financial assistance, on a
11 reimbursement basis, for the capital development and
12 improvement of park, recreation or conservation areas, marinas
13 and shorelines, including planning and engineering costs, and
14 for the acquisition of open space lands, including acquisition
15 of easements and other property interests less than fee simple
16 ownership if the Department determines that such property
17 interests are sufficient to carry out the purposes of this Act,
18 subject to the conditions and limitations set forth in this
19 Act.
20     No more than 10% of the amount so appropriated for any
21 fiscal year may be committed or expended on any one project
22 described in an application under this Act.
23     Any grant under this Act to a local government, except as

1 provided in this Section, shall be conditioned upon the State
2 state providing assistance on a 50/50 matching basis for the
3 acquisition of open space lands and for capital development and
4 improvement proposals. Those local governments defined as
5 "distressed" by the Department shall be eligible for up to 90%
6 State funding assistance provided that no more than 10% of the
7 amount so appropriated in any fiscal year under this Section is
8 made available for "distressed" local governments.

10     Section 99. Effective date. This Act takes effect upon
11 becoming law.
