AN ACT concerning State employment.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 1. Short title. This Act may be cited as the State Employment Credit Check Act.

Section 5. Definitions. For the purposes of this Act:

"Credit check" means the process of evaluating an applicant for State employment's loan requests at a financial institution, mortgage broker, retail mercantile establishment, or other lender in order to determine the likelihood that the borrower will live up to his or her obligations.

"State employment" means employment by a State agency as defined in Section 1-7 of the Illinois State Auditing Act.

Section 10. State employment applicants; credit checks. If a credit check is required by a State agency as part of the employment application process, the credit check must be conducted at the beginning of the interview process and not at the end of that process.
