SYNOPSIS AS INTRODUCED:

60 ILCS 1/30-26 new
605 ILCS 5/6-523 new

Amends the Township Code. Sets quorum requirements, based on township population, for annual and special township meetings. Transfers specified powers from the electors to the township board, but allows the electors to make recommendations to the township board and sets forth procedures for those recommendations. Provides that specified powers of the electors are not final unless approved at referendum. Amends the Highway Code to make conforming changes.

A BILL FOR

AN ACT concerning townships.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Township Code is amended by adding Section 30-26 as follows:

(60 ILCS 1/30-26 new)

Sec. 30-26. Limitations on township electors.

(a) This Section applies on and after the effective date of this amendatory Act of the 95th General Assembly.

(b) A quorum is required before the electors may take any action at an annual or special town meeting. Quorum requirements are based on the population of the township as follows: population under 10,000, 25 electors; population of 10,000 but under 25,000, 50 electors; population of 25,000 but under 50,000, 75 electors; population of 50,000 or more, 100 electors.

(c) Powers under the following Sections of this Code are transferred from the electors to the township board: Sections 30-45, 30-50, 30-53, 30-60, 30-65, 30-70, 30-75, 30-80, 30-85, 30-90, 30-95, 30-100, 30-105, 30-110, 30-115, 30-120, 30-125, 30-130, 30-135, 30-140, 30-145, 30-195, 35-40, 35-45, 220-15, and 220-35. Any action taken by the electors with respect to these transferred powers shall be a recommendation to the township board and advisory only. If the electors make a recommendation with respect to these transferred powers, then the township board shall give reasonable notice that at a regular or special meeting of the township board, not more than 30 days after the action of the electors, the public may comment on the advisability of the action recommended by the electors. The township board must vote on the action recommended by the electors at a regular or special meeting of the township board held not less than 90 days after the action of the electors making the recommendation.

(d) Actions taken by the electors under the following laws are not final and enforceable unless approved by the voters of the township at a referendum held in accordance with the general election law: 60 ILCS 1/235-5 and 235-10; and 605 ILCS 5/6-504, 6-508, and 6-508.1.

Section 10. The Illinois Highway Code is amended by adding Section 6-523 as follows:

Sec. 6-523. Limitations on township electors. This Code is subject to the limitations on township electors set forth in Section 30-26 of the Township Code.
