SYNOPSIS AS INTRODUCED:

New Act

Creates the Trans Fat Disclosure Act. Provides that a restaurant or similar retail food establishment must mark any food containing 0.5 grams or more of trans fat with a label on its menu stating that the food contains trans fat. Provides that this requirement applies only to restaurants and similar retail food establishments with $20 million or more in annual gross sales. Requires the Department of Public Health to adopt rules to administer and enforce the Act.

AN ACT concerning public health.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 1. Short title. This Act may be cited as the Trans Fat Disclosure Act.

Section 5. Trans fat disclosure. A restaurant or similar retail food establishment must mark any food containing 0.5 grams or more of trans fat with a label on its menu stating that the food contains trans fat. This Section applies only to restaurants and similar retail food establishments with $20 million or more in annual gross sales.

Section 10. Administration; enforcement. The Department of Public Health shall adopt rules to administer and enforce this Act, including the imposition of a civil penalty.
