SYNOPSIS AS INTRODUCED:

625 ILCS 5/5-110 new

Amends the Illinois Vehicle Code. Creates the Automobile Dealer's License Task Force. Adds provisions governing the composition and duties of the Task Force. Provides that the Secretary of State shall provide administrative support to the Task Force, and that the Task Force shall complete its work on or before December 31, 2022. Repeals the new provisions on January 1, 2024. Effective immediately.

A BILL FOR

AN ACT concerning transportation.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Illinois Vehicle Code is amended by adding Section 5-110 as follows:

(625 ILCS 5/5-110 new)

Sec. 5-110. Automobile Dealer's License Task Force. There is created the Automobile Dealer's License Task Force within the Office of the Secretary of State. The Task Force shall consist of the following members:

(1) the Secretary of State, or his or her designee, who shall serve as the Chair of the Task Force;

(2) one member of the General Assembly, appointed by the President of the Senate;

(3) one member of the General Assembly, appointed by the Minority Leader of the Senate;

(4) one member of the General Assembly, appointed by the Speaker of the House of Representatives;

(5) one member of the General Assembly, appointed by the Minority Leader of the House of Representatives;

(6) the Director of Revenue, or his or her designee;

(7) the Director of State Police, or his or her designee;

(8) the Director of Commerce and Economic Opportunity, or his or her designee;

(9) a representative of the Illinois Automobile Dealers Association;

(10) a representative of a nontraditional vehicle dealer that does not include anyone licensed under this Chapter;

(11) the Attorney General, or his or her designee;

(12) a representative of the Alliance of Automobile Manufacturers; and

(13) a representative of an Illinois-based entity that recognizes the need to be licensed and regulated by the State as a used motor vehicle dealer, but desires to use a business model that does not conform to the current regulations regarding the licensing of used motor vehicle dealers.

The Task Force shall hold an initial meeting within 60 days after the effective date of this amendatory Act of the 101st General Assembly and shall meet at least 2 times after the initial meeting.

The Task Force shall conduct a study relating to the licensing and oversight of nontraditional vehicle dealers, including, but not limited to, new manufacturers, Internet brokers, and any other nonconventional entity acting as a vehicle dealer in this State. As used in this Section, "nontraditional vehicle dealer" does not include a dealer licensed under this Chapter.

The Task Force shall report the findings of the study to the General Assembly on or before December 31, 2022.

The Office of the Secretary of State shall provide staff and administrative support to the Task Force.

This Section is repealed on January 1, 2024.

Section 99. Effective date. This Act takes effect upon becoming law.
