SYNOPSIS AS INTRODUCED:
 
220 ILCS 5/Art. XX heading new
220 ILCS 5/20-1 new
220 ILCS 5/20-5 new
220 ILCS 5/20-10 new
220 ILCS 5/20-15 new

    Amends the Public Utilities Act. Creates the Sale of Nuclear Power to Electric Utilities Article in the Public Utilities Act. Requires nuclear power generation companies located in Illinois to sell 70% of the electricity generated each year to Illinois electric utilities for a period of 10 years. Provides that the Illinois Commerce Commission may adopt rules for the implementation and enforcement of the Article. Effective immediately.

1     AN ACT concerning regulation.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Public Utilities Act is amended by adding
5 Article XX as follows:

ARTICLE XX. SALE OF NUCLEAR POWER TO ELECTRIC UTILITIES

 
8     (220 ILCS 5/20-1 new)
9     Sec. 20-1. Short title. This Article may be cited as the
10 Sale of Nuclear Power to Electric Utilities Law.
 
11     (220 ILCS 5/20-5 new)
12     Sec. 20-5. Definitions. In this Article:
13     "Electric utility" has the same meaning given to the term
14 in Article XVI of this Act.
15     "Nuclear power generating company" means any corporation
16 or company that owns one or more nuclear power generating
17 plants in the State whose construction was subsidized by the
18 State.
 
19     (220 ILCS 5/20-10 new)
20     Sec. 20-10. Required sale of nuclear-generated electricity
21 to electric utilities. A nuclear power generating company must
22 sell 70% of its annual production of electrical power to
23 electric utilities located in the State for a period of 10
24 years after the effective date of this amendatory Act of the
25 94th General Assembly.

27     Sec. 20-15. Rules for the implementation and enforcement of
28 this Article. The Illinois Commerce Commission may adopt any

1 rules that it deems necessary to implement and enforce this

3     Section 99. Effective date. This Act takes effect upon
4 becoming law.
